Date: January 22 2003 Margadet Monroe, City Plann�-- er RESOLUTION APPROVING CATEGORICAL EXEMPTION, AMENDMENT TO DESIGN REVIEW AND CONDITIONAL USE PERMIT, AND SPECIAL PERMIT RESOLUTION 005-2003 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for an amendment to design review and conditional use permit and a newspecial ermit for a first and second story addition at 900 Morrell Avenue zoned R-1 Kenneth and Andreanna Vierra property owners APN• 029-031- 060; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on January 13, 2003, at which time it reviewed and considered the staffreport and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section 15301 Class 1(e)(2) - additions to existing structures provided the addition will not result in an increase of more than 10,000 SF in areas where all public services and facilities are available and the area in which the project is located is not environmentally sensitive, is hereby approved. 2. Said design review and conditional use permit amendment and special permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such design review and conditional use permit amendment and special permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the officiaZrecor s of the County of San Mateo. CHAIRMAN I, Ralph Osterling , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 13`' day of January, 2003 , by the following vote: AYES: COMMISSIONERS: Auran; Bojues; Brownrigg; Kerighran; I{eele; Osterling; Vistica NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: NONE , fil� q5' /e 7 SECRETARY EXHIBIT "A" Conditions of approval for categorical exemption, design review and conditional use permit amendment, and special permit. 900 Morrell Avenue effective January 21, 2003 that the project shall be built as shown on the plans submitted to the Planning Department date stamped October 21, 2002, sheets A7 and A8, date stamped September 19, 2002, sheet A3, and and revised plans date stamped November 26, 2002, sheets Al, A5 and A6, and date stamped December 18, 2002, sheet A4, and that any changes to the footprint or floor area of the building shall require and amendment to this permit; 2. that any further changes to the size or envelope of the first or second floors, which would include adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the roof height or pitch, shall be subject to design review; that the conditions of the City Engineer's September 23, 2002, memo and the Recycling Specialist's September 24, 2002, memo shall be met; 4. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof ridge and provide certification of that height to the Building Department; 5. that prior to final inspection, Planning Department staff will inspect and note compliance of the architectural details (trim materials, window type, etc.) to verify that the project has been built according to the approved Planning and Building plans. 6. that prior to scheduling the framing inspection, the project architect, engineer or other licensed professional shall provide architectural certification that the architectural details such as window locations and bays are built as shown on the approved plans; if there is no licensed professional involved in the project, the property owner or contractor shall provide the certification under penalty of perjury. Certifications shall be submitted to the Building Department; 7. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction Plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; 8. that if construction is done during the wet season (October 15 through April 15), the developer shall implement a winterization program to minimize the potential for erosion and polluted runoff by inspecting, maintaining and cleaning all soil erosion and sediment control prior to, during, and immediately after each storm even; stabilizing disturbed soils throughout temporary or permanent seeding, mulching matting, or tarping; rocking unpaved vehicle access to limit dispersion of mud onto public right-of-way; covering/tarping stored construction materials, fuels and other chemicals; 9. that the second floor dormer windows on the right side shall be wood windows with 1 %z inch stucco mold trim and opaque glass; 10. that second floor dormer windows on the right side shall be no greater than 4'-0" in height and that the application shall return to the Planning Commission as an FYI item if the windows do not meet this requirement; and 11, that the project shall meet all the requirements of the California Building Code and California Fire Code, 1998 edition, as amended by the City of Burlingame. rd
