Date: 9/8/03 SA I �G Mar aret Monroe, hiy Planner RESOLUTION 076-2003 RESOLUTION APPROVING CATEGORICAL EXEMPTION AND CONDITIONAL USE PERMIT RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a conditional use permit for additions to an existing accessory structure to be used as a pool house at 16 Davis Court, zoned R-1, A.H. Jurow, property owner, APN: 025-181-010; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on August 25, 2003, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per Section: Section: 15303 - New Construction or conversion of small structures, Class 3(e), construction and location of limited numbers of new, small facilities or structures including (e) accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences. 2. Said conditional use permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such conditional use permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. 1 rllyi AURAIN , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 25th day of Au Lg ust , 2003 , by the following vote: AYES: COMMISSIONERS: Auran; Bojues; Brownrigg; Keighran; Vistica NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: Osterling ABSTAIN: COMMISSIONERS Keele SECRETARY EXHIBIT "A" Conditions of approval for categorical exemption and conditional use permit 16 Davis Court effective September 4, 2003 that the accessory structure shall be built as shown on the plans submitted to the Planning Department and date stamped June 20, 2003; with 1,422 SF of floor area, including 196 SF of ceiling space over 12-feet in height and 112 SF of covered porch areas; and shall be used only for family recreation and entertainment purposes; 2. that the accessory structure shall never include a kitchen (a stove), shall never include and indoor shower, and shall never be rented or converted to a second dwelling unit; that the conditions of the Chief Building Official's and the City Engineer's June 23, 2003, memos shall be met; and 4. that the project shall meet all the requirements of the California Building and Fire Codes, 2001 edition, as amended by the City of Burlingame.
