RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND PARKING VARIANCE
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
parking variance for a fitness studio with 27 on -site parking spaces where 35 on -site parking
spaces are required at 755 California Drive, K & B Investments, property owners, APN: 029-
053-090 & 029-053-100;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
November 24, 2003, at which time it reviewed and considered the staff report and all other
written materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is no
substantial evidence that the project set forth above will have a significant effect on the
environment, and categorical exemption, per CEQA Article 19, Categorically Exempt per
Section: 15301 - Existing facilities, Class 1(a), interior or exterior alterations involving
such things as interior partitions, plumbing, and electrical conveyances.
2. Said parking variance is approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such parking variance are as set forth in the minutes and
recording of said meeting.
It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

Conditions of approval for categorical exemption and parking variance.
755 California Drive
Effective December 4, 2003
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped October 9, 2003, site plan and floor plan; with a total of 27 on -site
parking spaces including required disabled accessible spaces dimensioned and marked in
the on -site parking area to the standards in the zoning and building codes effective in
2003;
2. that the building shall have 4,481 SF of gym area and 639 SF of aerobic classroom space,
any change to this configuration shall be reviewed by the Planning Department and may
require Planning Commission approval for change to the parking variance;
3. that if the building envelope is ever increased or the building demolished the 8 space
parking variance shall be void;
4. that this use and the parking variance shall be reviewed upon complaint;
5. that the two parcels, 029-053-090 and 029-053-100 on which the subject building is
located shall be legally merged prior to issuance of a building permit;
6. that signs notifying the public that jaywalking on California Drive is illegal shall be
posted by the sidewalk at the entrances to the site and inside and out side of the entrance
doors to the building to notify all employees and members that it is illegal to jaywalk
across California Drive and to direct them to the nearest legal crosswalk, in addition all
members shall be notified in their membership paper work that jaywalking across
California Drive is illegal and unsafe, the wording on all warning notices and signs shall
be approved by the City Engineer prior to their installation or use;
7. all signage on site shall require a separate permit from the Planning and Building
Departments;
8. that the conditions of the Fire Marshal's, Chief Building Official's and Recycling
Specialist's October 14, 2003 memo shall be met; and
9. that any improvements made for the approved use shall meet all California Building and
Fire Codes, 2001 Edition, as amended by the City of Burlingame.
