Date: 12/05/03 Mar+ ret Monroe, Cit Planner RESOLUTION 099-2003 RESOLUTION APPROVING MITIGATED NEGATIVE DECLARATION RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a mitigated negative declaration has been proposed and application has been made for construction of a new warehouse buildine at 1348-1368 Rollins Road, zoned M-1, Pietro Partners L.L.C., 3210 Fillmore Street #3 San Francisco CA 94123 Property owner, APN• 026- 123-050 & -060; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on November 24, 2003, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and mitigated negative declaration, per Mitigated Negative Declaration No. ND-530P, is hereby approved. 2. Said mitigated negative declaration is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such mitigated negative declaration are as set forth in the minutes and recording of said meeting. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. I, Tirn 4tNa-4'V ,SecretaryofthePlanning Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 24th day of November, 2003, by the following vote: AYES: COMMISSIONERS: NOE: COMMISSIONERS: ABSENT: COMMISSIONERS Auran, Bojues, Osterling, Vistica NONE Brownrigg, Keele, ABSTAIN: COMMISSIONERS: NONE Secretary EXHIBIT "A" Conditions of approval for mitigated negative declaration. 1348-1368 Rollins Road Effective December 4, 2003 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped November 5, 2003, sheet A-1, and date stamped July 11, 2003, sheet A-2, with the exception of the ground sign which requires a separate sign permit application; 2. that three, 24-inch box London Plane trees (Platanus Acerifolia) and Rhaphiolepis Ballerina shrubs maintained at a maximum height of three feet in height shall be planted in the landscape areas fronting Rollins Road as shown on the Site Plan, sheet A-1, date stamped November 5, 2003; 3. that loading and unloading of the storage containers, construction equipment, and any other goods and equipment associated with the businesses at this site shall occur within the building through one of the six roll -up doors on Marsten Road or through the roll -up doors in the parking lot facing Rollins Road; loading and unloading shall not be allowed on Marsten Road or Rollins Road, or in the on -site parking areas; the driveways in front of the roll -up doors on Marsten Road and in the parking area fronting Rollins Road shall be maintained clear and trucks shall not be stored or parked in the driveways; 4. that the conditions of the City Engineer's May 27, 2003 memo, the Fire Marshal's May 28, 2003, memo, the Chief Building Official's May 27, 2003 memo and the Recycling Specialist's May 21, 2003 memo shall be met; 5. that the 41 on -site parking spaces shall be used only for the customers and employees of the businesses at this site and shall not be leased or rented for storage of automobiles either by businesses on this site or by other businesses for off -site parking; 6. that the landscaping noted on sheet A-1 shall be installed according to plan and shall be irrigated with an automatic irrigation system; landscaping that does not survive on the site shall be immediately replaced with an equivalent species; 7. that this project shall meet all the requirements of the California Building and Uniform Fire Codes, 2001 Edition, as amended by the City of Burlingame; 8. that the driveway at the southern end of the site along Rollins Road shall be dedicated only as an 'entrance' to the parking area along Rollins Road and the driveway at the northern end of the site shall be dedicated only as an 'exit' from the parking area; the applicant shall install "Enter Only" and "Exit Only" signs at the driveways and shall paint the driveway pavement "Enter Only" and "Exit Only" with arrows to clearly indicate the vehicle direction; EXHIBIT "A" Conditions of approval for mitigated negative declaration. 1348-1368 Rollins Road Effective December 4, 2003 Page 2 9. that the applicant shall apply to the City to install a red painted curb for a distance of 10'- 0" back from the driveway exit at the north end of the site; when approved the painted red curb shall be installed to comply with City standards and shall be inspected by the Public Works Department for compliance prior to the final inspection; 10. that the grading plan shall be prepared by a licensed Engineer and approved by the City Engineer before a grading permit is issued. All applicable requirements of National Pollutant Discharge Elimination System (NPDES) shall be adhered to in the design and during construction, including the following listed below; 11. that all runoff created during construction and future discharge from the site shall be required to meet National Pollution Discharge Elimination System (NPDES) standards; 12. that drainage from paved surfaces, including parking lots, driveways and roofs shall be routed to storm water inlets equipped with sand/oil-separators and/or fossil filters, then the water shall be discharged into the storm drain system; the property owners shall be responsible for inspecting and cleaning (vacuuming out) sand/oil separators and changing fossil filters on a regular basis as well as immediately prior to, and once during, the rainy season (October 15 — April 1) and as directed by the City; 13. that off -site runoff shall be diverted around the construction site and all on -site runoff shall be diverted around exposed construction areas; 14. that methods and procedures such as sediment basins or traps, earthen dikes or berms, silt fences, straw bale dikes, check dams storm drain inlet protection soil blanket or mats, and covers for soil stock piles to stabilize denuded areas shall be installed during construction to maintain temporary erosion controls and sediment control continuously until permanent erosion controls have been established; 15. that the site shall be sprayed with water to control dust during grading and construction. Construction equipment emissions shall be in compliance with the standards of the Bay Area Air Quality Management District; 16. that a construction fence, including a impermeable fabric/material, shall be required around the site during construction to keep all construction debris on site; 17. that the gates located at each of the driveway entrances shall be automatic and remain in the open position during business hours to allow unrestricted access to the site and all of the on -site parking spaces; after hours employees using the site shall have access through the automatic gate; EXHIBIT "A" Conditions of approval for mitigated negative declaration. 1348-1368 Rollins Road Effective December 4, 2003 Page 3 18. that if any trenching is proposed on the site, the applicant shall contact the San Mateo County Health Department; if any contaminated soil is encountered, the applicant shall follow County protocol for its disposal; 19. that all construction shall abide by the construction hours established in the City of Burlingame Municipal Code, and shall occur only between the hours of 7:00 a.m. and 7:00 p.m. on weekdays, 9:00 a.m. and 6:00 p.m. on Saturdays, and 10:00 a.m, and 6:00 p.m. on Sundays and holidays; 20. that on -site illumination shall be shielded and directed only on to the site in compliance with the City's exterior illumination ordinance; 21. that all parking areas should be lit for safety at night, such lighting should comply with the requirements of the City's exterior illumination ordinance; and 22. that if any prehistoric or historic archeological relics are discovered during grading and construction, all work will be halted until the finding can be fully investigated and proper protection measures, as determined by qualified experts, can be implemented.
