RESOLUTION APPROVING CATEGORICAL EXEMPTION,
PARKING VARIANCE AND CONDITIONAL USE PERMIT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
conditional use permit and parking variance for a commercial recreation use (Pilates Studio with classes and
individual instruction) at 1209 Howard Avenue, Suites 203 and 204; zoned C-1 Subarea B Charles Andrews
Trust, property owner, APN: 029-224-300,
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
November 24, 2003, at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received
and addressed by this commission, it is hereby found that there is no substantial evidence that the project set
forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article
19, Section 15301, Existing facilities, Class 1(a), interior or exterior alterations involving such things as
interior partitions, plumbing, and electrical conveyances is hereby approved.
2. Said conditional use permit and parking variance are approved, subject to the conditions set
forth in Exhibit "A" attached hereto. Findings for such conditional use permit and parking variance are as set
forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records of
the County of San Mateo.

Commission held on the 24th day of November, 2003 , by the following vote:

Conditions of approval for categorical exemption, parking variance and conditional use permit
1209 Howard Avenue, Suites 203 and 204
effective December 5, 2003
that the Pilates studio with class and instruction shall be limited to 294 SF in Suite 203 and individual
instruction limited to 180 SF in Suite 204, and the remaining 180 SF in Suite 204 shall onlybe used as
an office for this business at 1209 Howard Avenue, as shown on the plans submitted to the Planning
Department date stamped September 19, 2003, Floor Plan for Suites 203 and 204; date stamped
October 10, 2003, Site Plan and Parking Diagram; and date stamped November 10, 2003, Second
Floor Plan (8 1/2" x 11");
2. that the hours of operation for the Pilates studio in Suite 203 shall be between the hours of 7:00 a.m. to
9:00 p.m., Monday through Saturday with a maximum of 5 classes each weekday, 7 classes on
Saturday and no classes on Sunday, and a maximum of two employees, including the business
manager in this suite at any one time;
3. that instructional classes in Suite 203 shall be limited to a maximum of 8 students at any one time and
shall be limited to 5 classes on weekdays and 7 classes on Saturdays beginning at 7:30 a.m.; no classes
shall be scheduled between 12:00 noon and 3:00 p.m.; classes shall be scheduled so that there is a 15-
minute break after each class before the next class begins and no classes shall be held at any time in
Suite 204;
4. that any changes in operation, floor area, use, or number of employees, which exceeds the maximums
as stated in these conditions shall require an amendment to this use permit;
5. that if this Commercial Recreation use with classes and individual instruction vacates the premises,
Suites 203 and 204 shall revert to an office use, at that time this four -space parking variance will
become null and void;
6. that 1224 SF on the second floor shall be used for storage for businesses on this site;
7. that if the structure is demolished, or damaged or remodeled more than 50% of its value at a later date,
the parking variance granted here will become void;
8. that to support the Pilates use, once the lease expires for Suite 200, the property owner shall reserve
only 4 spaces for that business rather than 5 spaces, and this space shall be open for use by on -site
customers and employees;
9. that the property owner shall reserve 3 on -site parking spaces for the Pilates use by signing them
reserved for the Pilates use from 7:00 a.m. to 10:00 a.m, and from 5:00 p.m. to 8:00 p.m., and during
the rest of the day these spaces would be available for other customers of the businesses on this site;
10, that the pedestrian opening between this site and City Parking Lot F shall never be closed or fenced;
and
11. that the use and any improvements for the use shall meet all California Building and Fire Codes, 2001
Edition as amended by the City of Burlingame.
