Date: 12/05/03 r 1 �— Mar t aret Monroe, 0jty Planner RESOLUTION 097-2003 RESOLUTION APPROVING CATEGORICAL EXEMPTION AND CONDTIONAL USE PERMIT RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a conditional use permit for a mortgage broker office in the C-1, Subarea A zoning district at 1409 Chapin Avenue; Five Ds Investment Company, property owner, APN: 029-122-220; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on November 24, 2003, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Categorically Exempt per Section: 15301 - Existing facilities, Class l(a), interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances. 2. Said conditional use permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such conditional use permit is as set forth in the minutes and recording of said meeting. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo, I, I rY1 A U✓a ✓1 Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 24t11 day of November 2003, by the following vote AYES: COMMISSIONERS: Auran, Bojues, Osterling, Vistica NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: Brownrigg, Keele, ABSTAIN: COMMISSIONERS: NONE 1� Secretary EXHIBIT "A" Conditions of approval for categorical exemption and conditional use permit. 1409 Chapin Avenue Effective December 4, 2003 that the mortgage broker office shall be limited to 3,030 SF at 1409 Chapin Avenue, on the mezzanine, as shown on the plans submitted to the Planning Department and date stamped October 24, 2003, site plan and November 13, 2003, floor plan; 2. that the mortgage broker office shall have regular business hours from 8:00 a.m. to 5:00 p.m. Monday through Friday; 3. that the maximum number of employees in this tenant space, mezzanine (second floor), shall be limited to 9, with 3 to 4 customers a day; 4. that any changes to the floor area, use, hours of operation, or number of employees which exceeds the maximums as stated in these conditions shall require an amendment to this conditional use permit; and that any improvements for the use shall meet all California Building and Fire Codes, 2001 Edition as amended by the City of Burlingame.
