RESOLUTION NO. 35 - 83
ORDERING, THE VACATION OF SEWER
EASEMENT WITHIN MILLS CANYON
RESOLVED by the CITY COUNCIL of the City of Burlingame:
WHEREAS, said City Council did on the second day of May, 1983,
adopt its certain Resolution No. 33- 83, entitled "Resolution Declaring
Intention to Vacate and Abandon Sewer Easement within Mills Canyon", declaring
its intention to vacate and abandon that certain sewer easement which is more
particularly described in Exhibit A attached to said Resolution; and
WHEREAS, said Resolution No. 33 -83 recites that said proceedings
were being taken under and pursuant to the Public Service, Public Streets,
Highway and Easements Vacation Law of the State of California, and expressed
the election of this Council to proceed under said law; and
WHEREAS, said Resolution No. 33-83 was duly adopted, published and
posted in the time, manner and form provided by law, all as appears in the
fidavit of Publication and Declaration of Posting on file in the office of
he City Clerk of said City; and
WHEREAS, copies of said Resolution were conspicuously posted as the
tices of easement vacation in the manner required by law along the lines of
sewer easement proposed to be vacated, which said notices stated the time
Place of hearing and the adoption of said Resolution No. 33-83; and
WHEREAS, Monday the 6th day of June, 1983, at the hour of eight o'clock
.m., at the Council Chambers of the City Council in the City Hall in the City
f Burlingame was fixed in said Resolution No. 33-83 as the time and place
and where any and all persons interested should appear and offer evidence
n connection with said vacation of said sewer easement; and
WHEREAS, after hearing the evidence, the City Council finds that said
easement hereinabove described is unnecessary for present or prospective
4/26/83 bublic use;
NOW, THEREFORE, IT IS HEREBY ORDERED that said sewer easement as
hereinabove described be, and it hereby is, vacated and abandoned.

certify that the foregoing Resolution was introduced at a regular meeting of
the City Council held on the 6th day of June ,1983, and was
adopted thereafter by the following vote:
