HomeMy WebLinkAboutReso - CC - 031-1983_0231J JHHW:LCJ:jla RESOLUTION NO. 31-83 A RESOLUTION RATIFYING APPROVAL AND AUTHORIZING EXECUTION OF FINANCING DOCUMENTS PERTAINING TO THE LEASING OF WASTEWATER TREATMENT PLANT IMPROVEMENT PROJECT AND RELATED IMPROVEMENTS FOR THE CITY OF BURLINGAME 05/16/83 RESOLVED, by the City Council of the City of Burlingame, California (the "City"), as follows: WHEREAS, the City is proposing to proceed with the leasing of certain wastewater treatment plant improvements to be installed at the City's wastewater treatment plant (the "Project"); and WHEREAS, by Resolution No. 26-83, the City Council has approved the form and authorized execution of certain documents pertaining thereto; and WHEREAS, the payment schedule provisions of the documents heretofore approved were previously unavailable and therefore not included in the documents approved by Resolution No. 26-83; and WHEREAS, a Bid for the Purchase of City of Burlingame, California, Certificates of Participation has been submitted by Merrill Lynch White Weld Capital Markets Group, has been reviewed by the financing consultant to the City, special counsel to the City, the City Attorney, and other qualified officers of the City, and has been found to be the lowest responsible bidder for the Certificates. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Burlingame that: SECTION 1. Approval of the forms of those documents enumerated and described in Resolution No. 26-83 are hereby ratified and authority to execute those documents with the payment schedule provisions now included therein is hereby reconfirmed. SECTION 2. The Proposal for Certificates submitted by Merrill Lynch White Weld Capital Markets Group, as successful bidder for the certificates, is hereby approved and the City Manager is authorized to execute the proposal for and on behalf of the City of Burlingame. SECTION 3. The City Manager is hereby authorized to approve revisions to any of the documents referred to herein, provided that the City Attorney and other qualified officers of the City and special counsel to the City concur in his determination that any revision is not inconsistent with the essential terms of such documents. SECTION 4. The City Manager, City Clerk, and other qualified officials of the City are hereby authorized and directed to execute such other documents and certificates as may be necessary to effect the proposals of this resolution and the installment purchase financing authorized herein. Mayor I, EVELYN H.
