Date December 8, 2023 CITY EU Rr-tNGA}I E ILTigI Kevin Gardiner, AICP, Community Development Director RECORDING REQUESTED BY: b( bt^,i,n Aailiutt CITY OF BURLINGAME PLANNING COMMISSION REsoLUfloN No. bL) - I l,U{- q B WHEREAS, State Housing Element Law (Government Code Sections 65580 et seq.) requires that the City of Burlingame (the City) adopt a housing element for the eighlyear period 2023-2Q31 to accommodate the regional housing need allocation (RHNA) assigned to the City by the Association of Bay Area Governments ot 3,257 housing units, comprised of 863 units affordable to very-low income households, 497 units affordable to low-income households, 529 units affordable to moderate-income households, and 'l ,368 units affordable to above moderate-income households; and WHEREAS, to comply with State Housing Element Law, the City has prepared a 2023-2031 Housing Element (the "Housing Element") in compliance with State Housing Element Law and has identified sites that can accommodate housing units meeting the City's RHNA; and WHEREAS, the preparation, adoption, and implementation of the Housing Element requires a diligent effort to include all economic segments of the community; and WHEREAS, the City conducted extensive community outreach over twenty months, beginning in March 2022, as described in detail in Appendix B to the proposed Housing Element; and WHEREAS, in accordance with Government Code Section 65585(b), on December 28,2022, the City posted the draft Housing Element and requested public comment for a 30-day review period; and 2213\02L1646971 I A RESOLUTION OF THE CITY OF BURLINGAME PLANNING COMMISSION RECOMMENDING THAT THE CITY COUNCIL ADOPT A GENERAL PLAN AMENDMENT TO REPEAL THE20'15.2023 CITY OF BURLINGAME HOUSING ELEMENT, AND ADOPT THE2023.2031 CITY OF BURLINGAME HOUSING ELEMENT, IN COMPLIANCE WITH STATE HOUSING ELEMENT LAW WHEREAS, the California Legislature has found that "California has a housing supply and affordability crisis of historic proportions. The consequences of failing to effectively and aggressively confront this crisis are hurting millions of Californians, robbing future generations of the chance to call California home, stifling economic opportunities for workers and businesses, worsening poverty and homelessness, and undermining the state's environmental and climate objectives" (Gov. Code Section 65589.5.); and WHEREAS, on January 9,2023, the Planning Commission and on January 17, 2023 the City Council held duly and properly noticed public meetings to take public testimony and review the proposed Housing Element; and WHEREAS, on February 17 ,2023, after responding to public comments, submitted the draft Housing Element to the State Department of Housing and Community Development (HCD) for its review; and WHEREAS, on May 18,2023 lhe City received a letter from HCD providing its findings regarding the draft Housing Element; and WHEREAS, on September 6 ,2023 the City published a revised draft Housing Element responding to HCD's findings and requested public comment on the draft; and WHEREAS, on September 15,2023 the City submitted a second draft Housing Elemenl to HCD, and WHEREAS, on November 2,2023 lhe City published a third draft Housing Element that responded to informal comments received from HCD; and WHEREAS, on November 10,2023 the City submitted a third draft Housing Element to HCD; and WHEREAS, based on rapidly expanding demand for residential land in the region and the underutilized nalure of the sites identified in the sites inventory, the existing uses on the sites identified in the site inventory to accommodate the lower income RHNA are likely to be discontinued during the planning period, and therefore do not constitute an impediment to additional residential development during the period covered by the housing element; and WHEREAS, on January 7, 2019 the City Councit adopted the CEeA Finding of Fact, Statement of Significance, and Mitigation Monitoring and Reporting Program, and certified the Environmental lmpact Report for the Burlingame General Plan (SCH#20170820'18) (the "General Plan ElR"); and WHEREAS, on January 7, 2019 the City Council adopted the Burlingame General Plan document, and 22ll\02\1646971 I WHEREAS, on November 15,2023 the City received a letter from HCD stating that the draft Housing Element, along with revisions, meets the statutory requirements and that the Housing Element will substantially comply with Housing Element Law when it is adopted, submitted to, and approved by HCD, in accordance with Government Code Section 65585; and WHEREAS, the proposed Housing Element is considered an amendment to the Burlingame General Plan; and WHEREAS, pursuant to CEQA Guidelines Section 15164, the City has prepared an Addendum, which is incorporated herein by reference as Exhibit B to this resolution, affirming that the analysis contained in the General Plan EIR adequately addresses the potential physical impacts associated with implementation of the proposed Housing Element; and WHEREAS, the Addendum was prepared in compliance with the requirements of the California Environmental Quality Act and the State CEQA Guidelines; and WHEREAS, based upon the evidence submitted and as demonstrated by the analysis included in the Addendum, none of the conditions described in Sections 15162 and 151 63 of the State CEQA Guidelines calling for the preparation of a subsequent or supplemental EIR or negative declaration have occurred; specifically. a. There have not been any substantial changes in the project that require major revisions of the EIR because of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; b. There have not been any substantial changes with respect to the circumstances under which the project is undertaken that require major revisions of the EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects, and c. There is no new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the Final EIR was certified that shows any of the following: (a) the project will have one or more significant effects not discussed in the Final EIR; (b) significant effects previously examined will be substantially more severe than shown in the Final EIR; (c) mitigation measures or allernalives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects of the project, but the project proponents decline to adopt the mitigation measure or alternative; or (d) mitigation measures or alternatives which are considerably different from those analyzed in the Final EIR would substantially reduce one or more signiflcant effects on the environment, but the pro.lect proponents decline to adopt the mitigation measure or alternative; and WHEREAS, the proposed Addendum demonstrates that none of the conditions described in CEQA Guidelines Section "15162 requiring preparation of a subsequent EIR or negative declaration exist; and 22rl\02u6,16974 r WHEREAS, on November 27,2023, the Planning Commission conducted a duly and properly noticed public hearing to take public testimony and consider this Resolution and the Addendum to The General Plan EIR regarding the proposed Housing Element, reviewed the proposed Housing Element, and all pertinent maps, documents and exhibits, including HCD's findings, the City's response to HCD's findings, the staff report and all attachments, and oral and written public comments. NOW, THEREFORE, THE CITY OF BURLINGAME PLANNING COMMISSION RESOLVES as follows, based on substantial evidence in the record: 1. The foregoing recitals are true and correct and are incorporated by reference into this action. 2. The Planning Commission has considered the Addendum attached as Exhibit B to this resolution as well as the General Plan ElR. 3. The Housing Element substantially complies with State Housing Element Law. 4. The City of Burlingame Planning Commission recommends that the City of Burlingame City Council repeal the 2O15-2023 Housing Element and adopt the Addendum to the General Plan EIR as well as the proposed Housing Element, as shown in Exhibits A and B, based on the following findings: a. The amendment is internally consistent with all other provisions of the General Plan. The Housing Element is conslsfenl with the General Plan and General Plan goals, policies, and implementation programs, which specify providing housing oppoftunities for all income ranges. The Housing Element maintains the land uses and residential densities provided in the General Plan Community Character (Land Use) Element. On the basls of the Final Environmental lmpact Repoft (FEIR) certified by the Bulingame City Council on January 7, 2019, the Environmental lmpact Repoft (EIR) Addendum dated November, 2023 and the documents submitted and reviewed, and comments received and addressed by this commission, it has been found that there is no substantial evidence that the Housing Element will have a significant effect on the environment beyond those that were previously evaluated in the certified FEIR for the 2040 General Plan. 22r3\02U646974 l b.
