RESOLUTION ESTABLISHING CRITERIA GRANTING AUTHORIry TO COMMUNITY
DEVELOPMENT DIRECTOR TO MAKE MINOR AMENDMENTS TO CONDITIONS OF
APPROVAL ON COMMERCIAL PROJECTS OVER 1O,OOO SQUARE FEET OR RESIOENTIAL
PROJECTS WITH MORE THAN FIVE UNITS WHEN SUCH AMENDMENTS PROMOTE
EFFECIENCY AND DO NOT ALTER THE INTENT OF THE STATED CONOITION
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, the Planning Commission is regularly tasked with approving permits for large
development projects within the City of Burlingame; and
WHEREAS, prior to Planning Commission approval, City Staff provides recommendations for
Condilions of Approval for a project which, once approved, detail the requirements for implementing
the approved project, and
WHEREAS, once the Planning Commission approves a project, along with its accompanying
Conditions of Approval, any requested changes to those Conditions must be presented to the Planning
Commission for approval; and
WHEREAS, many Conditions of Approval are administrative and/or procedural in nature, and do not
substantively affect the approved conditions of the project; and
WHEREAS, examples of procedural Conditions of Approval include the timing and implementation of
certain agreements with the City of Burlingame, as well as requirements to comply with rules of other
regulatory authorities with jurisdiction over the project; and
WHEREAS, section 25.88.0a0(c) of the Burlingame Municipal code allows the community
Development Director to make minor changes to a project that are consistent with the Zoning Code
and the spirit and intent of the original approval, following criteria established by the Planning
Commission; and
WHEREAS, the Planning Commission wishes to establish criteria to allow the Community
Development Director to approve minor amendments to a condition of Approval for a large
development project if he/she determines the amendments will promote efficiency and do not
substantively change the intent of the orjganally approved condition.
The Community Development Director is not required to approve a request for a minor
amendment. and may atways determine, in their sole discretion, that a proposed amendment
must be presented to the Planning Commission for review.
This authority shall only apply to conditions approved by the Planning Commission.

NOW, THEREFORE, it is RESOLVED and DETERMINED by this Ptanning Commission that:
1. The Community Development Director is granted authority to approve minor amendments to
Conditions of Approval for a Commercial Development Project over '10,000 Square Feet or a
Residential Project with more than Five Units if he/she determines that such amendments
would promote the efficiency of the project's construction and do not alter the intent of the
originally approved condition.
