CALL TO ORDER Chair Deal called the June 25, 2007, regular meeting of the Planning Commission to order at 7:02 p.m. II. ROLL CALL Present: Commissioners Auran, Brownrigg, Cauchi, Deal, Osterling, and Vistica Absent: Commissioner Terrones Staff Present: Community Development Director, William Meeker; Zoning Technician, Lisa Whitman; and City Attorney, Larry Anderson III. MINUTES Commissioner Cauchi moved, seconded by Commissioner Osterling to approve the minutes of the June 11, 2007 regular meeting of the Planning Commission as mailed. Passed 6-0-1-0 (C. Terrones absent). Commissioner Osterling noted that the property at 1324 Montero had not been cleaned up, per the direction noted in the June 11, 2007 minutes. City Attorney Anderson noted that staff would follow up. IV. APPROVAL OF AGENDA There were no changes to the agenda. V. FROM THE FLOOR There were no public comments. VI. STUDY ITEMS 1. 1414 ALVARADO AVENUE, ZONED R-1 – APPLICATION FOR FENCE EXCEPTION FOR A NEW 7'-2" TO 12'-2" HIGH FENCE LOCATED ON THE RIGHT SIDE AND REAR PROPERTY LINES (GEORGE AND DEBBIE OLDHAM, APPLICANTS AND PROPERTY OWNERS) PROJECT PLANNER: LISA WHITMAN Zoning Technician Whitman presented a summary of the staff report. Commission comments: ƒ The site at 1421 Benito Avenue (directly behind the subject site) has a new structure; it has limited landscaping at the rear of the lot. The approved landscape plan should be reviewed to determine if the property is in compliance. ƒ Need written confirmation that neighbors at 1412 Alvarado have agreed to increased fence height. ƒ Encouraged applicant to meet with City (Public Works) to determine options for landscaping within the easement behind the property (would require an Encroachment Permit). This item was set for the regular Action Calendar when all the information has been submitted and reviewed by the Planning Department. Chair Deal asked if anyone in the audience or on the Commission wished to call any item off the consent calendar. There were no requests. 2a. 1828 EL CAMINO REAL, SUITE 802, ZONED ECN – APPLICATION FOR CONDITIONAL USE PERMIT FOR A MASSAGE ESTABLISHMENT (ELIZABETH S. ANGELES, APPLICANT; INDEPENDENT HOLDINGS, LLC, PROPERTY OWNER; AND KEN IBARRA, ARCHITECT) (14 NOTICED) PROJECT PLANNER: RUBEN HURIN Commissioner Auran moved approval of the Consent Calendar based on the facts in the staff report, Commissioner’s comments and the findings in the staff report with recommended conditions in the staff report and by resolution. REGULAR ACTION ITEMS 3. 1610 CHAPIN AVENUE, ZONED R-1 – APPLICATION FOR A DESIGN REVIEW AMENDMENT FOR A FRONT PORCH ADDITION (ANNA MITTELSTADT, APPLICANT AND PROPERTY OWNER; AND JOANN GANN, DESIGNER) (34 NOTICED) PROJECT PLANNER: LISA WHITMAN Reference staff report dated June 25, 2007, with attachments. Zoning Technician Whitman presented the report, reviewed criteria and staff comments. Nine (9) conditions were suggested for consideration. Chair Deal opened the public hearing at 7:16 p.m. Joanne Gann, 111 Glen Way, San Carlos represented the applicant. Commission comments: ƒ Add a street tree in front of the house, selected from the City’s street tree list. There were no further comments and the public hearing was closed at 7:18 p.m. Commissioner Auran moved to approve the application, by resolution, with the following amended conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped May 2, 2007, Sheets 1 through 3, and that any changes to building materials, exterior finishes, footprint or floor area of the building shall require an amendment to this permit. A street tree, selected from the City’s street tree list, shall be added at the front of the property; 2. that the conditions of the Chief Building Official's May 3, 2007 memo, the City Engineer's May 7, 2007 memo, the Fire Marshal's May 7, 2007 memo, and the NPDES Coordinator's May 8, 2007 memo shall be met; 3. that the Variances for declining height envelope, floor area ratio, side setback and for number of parking spaces granted in November of 1999 were granted because of a pre-existing condition on City of Burlingame Planning Commission Approved Minutes June 25, 2007 3 the property which would impose an unfair burden on the owner to correct or remove as part of remodel; however, this condition could probably have been corrected if the structure were demolished and replaced; should the existing dwelling be demolished, the variances approved for declining height envelope, floor area ratio, side setback and for number of parking spaces shall automatically expire, and the owner may apply for a new variance or may improve the property so that it conforms to the Zoning Code requirements for declining height envelope, floor area ratio, setbacks and parking. In this case, "demolished" means removal of greater than ten (10) percent or more in square footage of the exterior walls than was approved in the design review application; 4. that demolition or removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 5. that any changes to the size or envelope of the basement, first or second floors, or garage, which would include adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the roof height or pitch, shall be subject to Planning Commission review; 6. that prior to final inspection, Planning Department staff will inspect and note compliance of the architectural details to verify that the project has been built according to the approved Planning and Building plans; 7. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2001 Edition, as amended by the City of Burlingame; 8. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; and 9. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management and Discharge Control Ordinance. There were no further comments and the public hearing was closed at 7:24 p.m. Commissioner Brownrigg moved to approve the application, by resolution, with the following amended conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped June 8, 2007, sheets A0.0 through A3.3, and that any changes to building materials, exterior finishes, footprint or floor area of the building shall require an amendment to this permit. Community Development Director Meeker presented the report, reviewed criteria and staff comments. Twelve (12) conditions were suggested for consideration. Chair Deal opened the public hearing at 7:22 p.m. George Skinner, 4231 Terrace Street, Oakland, represented the applicant. Commission comments: ƒ Have dimensions of pergola been confirmed by Planner? (Yes) ƒ Plans for railings don’t reflect what architect describes (Craftsman detailing). Revise plans to reflect what is intended. ƒ While trees are in full bloom, it is difficult to determine view impacts of addition. Should stipulate that the row of Birch and Cypress trees be topped to current height in future, as long as they exist on the site, as a condition of approval. ƒ Planning Commission supported request for a Variance from maximum FAR in order to permit a more inviting porch design that benefits the appearance of the neighborhood. Pat Giorni, 1445 Balboa, Burlingame, doesn’t think it is an imposition to include the stipulation to keep the trees topped to the current height as a condition of approval. There were no further comments and the public hearing was closed 7:44 p.m. Commissioner Osterling moved to approve the application, by resolution, with the following amended conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped June 11, 2007, sheets A-1 through A-8 and Landscape Plan, and that any changes to building materials, exterior finishes, footprint or floor area of the building shall require an amendment to this permit; 2. that, prior to issuance of a building permit for construction of the project, the existing height of the row of Birch and Cypress trees on the property shall be determined and noted for the record. Chair Deal opened the public hearing at 7:52 p.m. City of Burlingame Planning Commission Approved Minutes June 25, 2007 7 Eugene Lai, 3121 Margarita, represented the applicant. Commission comments: ƒ Are the existing windows to the left of the porch to be replaced and enlarged? ƒ Why was the roofline of the garage increased? Were the plans incorrect? ƒ The entry to the residence looks bare. ƒ Changes made to the building since the original approval are substantial. The changes have taken away the character of the structure. ƒ The excessive amount of paving within the front of the property is not good. ƒ There appears to be room for shutters to be installed, as planned. ƒ The glued-on stucco trim is not acceptable. Wood trim, as originally approved, should be installed. ƒ The windows installed include false grids in the glass. Did original approval require simulated true divided light windows? (No) ƒ Details of the originally approved design should be restored; but reversion of original garage roofline could be a significant financial impact. Mr. Lai responded as follows: ƒ The roofline of the garage was impossible to build as shown on the approved plans since the slab was two feet higher than indicated. ƒ He has no plans to revise the windows or make other changes to the entry. ƒ The placement of the downspout on the right side of the upper floor prevents the installation of shutters. There were no further comments and the public hearing was closed at 8:06 p.m. Motion by Commissioner Auran to send the project to a design review consultant for review, including restoration of design details and options for the garage roof. Chair Deal opened the public hearing 8:15 p.m. Mark Hudak, 216 Park Road, Burlingame, represented the applicant. He commented: ƒ The proposed business will be great addition to area. ƒ Knows that there is concern regarding the Monday meetings, but observed a lot of available parking during the meeting time today (6/25). This shouldn’t be a problem, but he is certain if problems occur a solution can be developed with the Community Development Director. ƒ The applicant has no problem bringing the proposed signage back to the Commission as an FYI item. City of Burlingame Planning Commission Approved Minutes June 25, 2007 8 Commission comments: ƒ Staff to bring signage back to the Commission as an FYI item. ƒ Observation of little impact on parking in area on day of weekly meeting. ƒ The statement that the maximum number of clients and employees on site at any time (10) would seem to be low, should perhaps be increased to 20. There were no further comments and the public hearing was closed at 8:24 p.m. Commissioner Brownrigg moved to approve the application, by resolution, with the following amended conditions: 1. that the real estate business shall be limited to 11,373 SF at 1427 Chapin Avenue, as shown on the plans submitted to the Planning Department and date stamped April 13, 2007, sheets A1.0, A2.0 and A2.1; 2. that signage approved for the business shall be presented to the Commission by staff as an FYI item; 3. that the real estate business may not be open for business except during the hours of 7:00 a.m. to 7:00 p.m., on weekdays and 9:00 a.m. to 5:00 p.m. on Saturday; agents may continue to use the office after normal business hours; on Sundays, the office shall not be formally open, but agents may use the office and may meet clients by appointment; 4. that weekly agent meetings shall be on Monday mornings between 9:00 a.m. and 10:30 a.m., with a maximum of 52 persons on site during the meeting which includes agents, full-time employees, and managers; 5. that the real estate business shall have a maximum employees/managers of 95 part-time agents and 4 full-time employees/managers (with a maximum of 20 persons on-site at any one time except on Monday from 9:00 a.m. to 10:30 a.m. for group meetings); the number of full-time or part-time real estate agents, employees and managers for a real estate use in 11,373 SF and the maximum of 20 persons on site except for one hour on Monday, shall not be increased without an amendment to this permit; 6. that due to the impact of weekly agent meetings on parking in this area, the owner agrees to schedule the weekly group meetings or client conferences so that the parking impact is minimized and will consult with the Community Development Director on an annual basis regarding any difficult times or days of the week and shall make adjustments that may be applicable; 7. that any changes in operation, floor area, use, or number of employees, which exceeds the maximums as stated in these conditions shall require an amendment to this use permit; 8. that the conditions of the Fire Marshal's April 13, 2007, memo shall be met; 9. that the use and any improvements for the use shall meet all the requirements of the California Building Code and California Fire Code, 2001 edition, as amended by the City of Burlingame; and 10. that this Conditional Use Permit shall be reviewed upon complaint. DESIGN REVIEW STUDY ITEMS 8. 446 CUMBERLAND DRIVE, ZONED R-1 – APPLICATION FOR DESIGN REVIEW AND PARKING VARIANCE FOR COVERED PARKING SPACE LENGTH FOR A FIRST FLOOR REMODEL AND SECOND STORY ADDITION TO A SINGLE FAMILY DWELLING (JENNY AND NICK VITRO, APPLICANT AND PROPERTY OWNER; AND EARLE WEISS, ARCHITECT) (65 NOTICED) PROJECT PLANNER: ERICA STROHMEIER Zoning Technician Whitman briefly presented the project description. There were no questions of staff. Chair Deal opened the public comment period at 8:29 p.m. Earle Weiss, 91 Louise Street, San Rafael, represented the applicant: ƒ The parking Variance is necessitated by the need to make the stairs from the garage into the residence more useable. Good locations for the stairs are limited. Commission comments: ƒ The existing den was possibly illegally constructed at some point, shortening the depth of the garage. A Variance is now being requested for the length of that garage, when the den seems to be the problem. Need to justify need for Variance in light of the existence of possibly bootlegged living space. ƒ Ensure that detailing between original portions of the house the proposed addition is consistent. ƒ Use exposed rafter tails on second level to match those on the first floor. ƒ The design of the front porch could use some work; more detailing. ƒ Avoid planting a Liquid Amber tree on the property, refer to the City’s street tree list for alternatives. ƒ Eliminate the residual portion of the existing flat roof at the rear of the structure. ƒ Eliminate unused flue/chase. ƒ How will the roof pitches be treated from an aesthetic standpoint and for drainage purposes? ƒ Concern about design of long dormer and the amount it projects out, could look odd. ƒ Consider clerestory windows on the vast plane of stucco on the second-story south wall, only as a suggestion, not a requirement, take into account neighbor’s privacy. Another vast plane of stucco will be created on the first story of the north elevation. Reconsider proposed removal of door and window. There were no other comments from the floor and the public hearing was closed at 8:52 p.m. Commissioner Brownrigg made a motion to place the item on the regular Action Calendar when complete. This motion was seconded by Commissioner Vistica. Chair Deal called for a vote on the motion to place this item on the regular Action Calendar when plans had been revised as directed. The motion passed on a voice vote 6-0-1-0 (Commissioner Terrones absent). The Planning Commission's action is advisory and not appealable. This item concluded at 8:54 p.m. 9. 518 BAYSWATER AVENUE, ZONED R-1 – APPLICATION FOR DESIGN REVIEW FOR A NEW TWO- STORY SINGLE FAMILY DWELLING WITH DETACHED GARAGE (JAMES CHU, CHU DESIGN & ENGINEERING, APPLICANT AND DESIGNER; AND SEAN MCKENNA, PROPERTY OWNER) (46 NOTICED) PROJECT PLANNER: ERICA STROHMEIER Zoning Technician Whitman briefly presented the project description. Chair Deal opened the public comment period at 8:57 p.m. James Chu, 55 West 43rd Avenue, San Mateo, represented applicant. Commission comments: ƒ Will address of property change when front door location is changed? ƒ Gingko tree requested by a property owner in the area, is shown on the landscape plan. ƒ Look for ways to provide finer detailing to break down scale of structure. ƒ Noted wood molding around windows and stone molding around entry, as well as real slate roof. ƒ Consider different treatment for fireplace on front of structure to minimize its mass. ƒ Limit six-foot portion of fence to area adjacent to lawn. Consider picket style, low decorative fence on corner of property, but work with Public Works to ensure that the design meets that department’s standards. ƒ Property needs to be maintained in better condition while permitting for new project is being considered. ƒ Consider replacing Pittosporum with either Camellia or Rhododendron. ƒ Agree with removal of Cypress tree; it crowds the house. ƒ Rear porch of family room will not be used much, would be used more if placed between the family room and dining room. ƒ Perhaps some sort of treatment at the base of the building could be proposed to create more of a story-book look. There were no other comments from the floor and the public hearing was closed at 9:10 p.m. Commissioner Auran made a motion to place the item on the Consent Calendar when complete. Commission comments: ƒ The proportions of the residence are fine and the design is appropriate for the neighborhood. ƒ Consider doing something more special with the window divisions, rather than using the same mullion pattern throughout. ƒ Landscape plan needs a lot of work. Provide a legible plan and a listing of plant materials. ƒ Need a walkway between the driveway and sidewalk. ƒ The concrete pad, presumably a sitting area, in the rear yard appears small and a great distance from the house; label the area on the plans. ƒ Roof over landing for stairs, shown on the right side of the rear elevation, appears too large. ƒ Review windows on either side of the entry door, they look tacked onto the house; consider something more rectangular to match the rest of the house. ƒ Incorporate more molding to enhance the architectural style of the house (heavy moldings and/or dental moldings). ƒ Incorporate a street tree into the landscape plan. ƒ Consult with neighbor to right of existing driveway to ensure that they are aware of desire to move driveway to opposite side of lot, and move the new structure closer to the adjacent property. COMMISSIONERS’ REPORTS At the Commission’s request, Chair Deal agreed to defer the discussion of subcommittee assignments to the next regular meeting of the Commission. XI. DIRECTOR’S REPORT Review of City Council regular meeting of June 18, 2007: ƒ Community Development Director Meeker noted that at the regular City Council Meeting of June 18, 2007, the Council adopted a Resolution approving the PHS/SPCA facility, to be located at 1450 Rollins Road/20 Edwards Court. ƒ An appeal of the window design for 2212 Hillside Avenue was received within the appeal period. The City Council will be asked to set the date for the appeal hearing at its next meeting, scheduled for July 16, 2007. ƒ Community Development Director Meeker also noted that, due to the Independence Day Holiday, the Planning Commission packet for July 9, 2007 will be delivered on Thursday, July 5th, rather than Wednesday, July 4th. City Attorney Anderson noted that he will not be at the next regular meeting. Dan Siegel will represent the City Attorney’s Office at the meeting. He referenced a recent Grand Jury report regarding e-mail correspondence and Commissions and City Councils. He will discuss the item with the Commission at its July 23rd meeting. Community Development Director Meeker noted the FYI item regarding the Mills-Peninsula Hospital construction project complaint log. XII.
