I. CALL TO ORDER
Chair Terrones called the August 10, 2009, regular meeting of the Planning Commission to order at 7:00
p.m.
II. ROLL CALL
Present: Commissioners Auran, Brownrigg, Terrones, Vistica and Yie
Absent: Commissioners Cauchi and Lindstrom
Staff Present: Community Development Director, William Meeker; Associate Planner, Erica Strohmeier;
and City Attorney, Gus Guinan
III. MINUTES
Commissioner Vistica moved, seconded by Commissioner Yie to approve the minutes of the July 27, 2009
regular meeting of the Planning Commission, as submitted.
Motion passed 4-0-2-1 (Commissioners Cauchi and Lindstrom absent, Commissioner Terrones abstained).
IV. APPROVAL OF AGENDA
There were no changes to the agenda.

There were no study items for review.
VII. ACTION ITEMS
Consent Calendar - Items on the Consent Calendar are considered to be routine. They are acted upon
simultaneously unless separate discussion and/or action is requested by the applicant, a member of the
public or a Commissioner prior to the time the Commission votes on the motion to adopt.
Commissioner Auran indicated that he would recuse himself from voting on Agenda Item 1 a (1333 Bernal
Avenue), since he resides within 500-feet of the property. He left the Council Chambers.
Chair Terrones indicated that he would abstain from voting on Agenda Item la, since he had not reviewed
the recording from the Design Review Study session for the item.

Given that only three (3) members would be able to vote to approve Agenda Item la as a Consent
Calendar Item, Commissioner Vistica pulled the item from the Consent Calendar so that a full public
hearing could be held, permitting four (4) of the Commissioners present to vote on the item.
VIII. REGULAR ACTION ITEMS
1a. 1333 BERNAL AVENUE, ZONED R-1 —APPLICATION FOR DESIGN REVIEW AND SPECIAL PERMIT
FOR HEIGHT FOR A FIRST AND SECOND STORY ADDITION TO A SINGLE FAMILY DWELLING
(DARYL BUCKINGHAM, APPLICANT AND DESIGNER; AND JOSEPH AND REBECCA LAMBING,
PROPERTY OWNERS) STAFF CONTACT: RUBEN HURIN
Reference staff report dated August 10, 2009, with attachments. Community Development Director Meeker
presented the report, reviewed criteria and staff comments. Twelve (12) conditions were suggested for
consideration.
Chair Terrones opened the public hearing.
Daryl Buckingham, 338 Ridge Road, San Carlos; and Joseph Lambing, 1333 Bernal Avenue; represented
the application.
Commission comments:
Not much proposed for landscaping; what is proposed in front of house? (Lambing — will landscape
the front as a separate project. Buckingham — two large trees at the front of the house provide a lot
of shade and visually impact the front of the house. Lambing — will likely install drought tolerant
landscaping.)
Bring a landscape plan back to the Commission as an FYI.
Public comments:
None.
Additional Commission comments:
Good project.
Commissioner Brownrigg moved to approve the application, by resolution, with the following amended
conditions:
that the project shall be built as shown on the plans submitted to the Planning Division date
stamped July 1, 2009, sheets A-0, A-0.1, A-1, A-1.1, A-1.4 through A-1.6, A-3, A-5 and A-11, and
date stamped August 3, 2009, sheets A-1.2, A-4.1 and A-4.2;
2. that the landscape plan for the property shall be submitted to, and reviewed by, the Planning
Commission as an FYI item, prior to final inspection of the new residence;
3. that any changes to building materials, exterior finishes, windows, architectural features, roof height
or pitch, and amount or type of hardscape materials shall be subject to Planning Division or
Planning Commission review (FYI or amendment to be determined by Planning staff);

4. that any changes to the size or envelope of the basement, first or second floors, or garage, which
would include adding or enlarging a dormer(s), shall require an amendment to this permit;
5. that the conditions of the Chief Building Official's May 29 and July 6, 2009 memos, the City
Engineer's June 9, 2009 memo and the Fire Marshal's and NPDES Coordinator's May 28, 2009
memos shall be met;
6. that demolition or removal of the existing structures and any grading or earth moving on the site
shall not occur until a building permit has been issued and such site work shall be required to
comply with all the regulations of the Bay Area Air Quality Management District;
7. that prior to issuance of a building permit for construction of the project, the project construction
plans shall be modified to include a cover sheet listing all conditions of approval adopted by the
Planning Commission, or City Council on appeal; which shall remain a part of all sets of approved
plans throughout the construction process. Compliance with all conditions of approval is required;
the conditions of approval shall not be modified or changed without the approval of the Planning
Commission, or City Council on appeal;
8. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that these
venting details shall be included and approved in the construction plans before a Building permit is
issued;
9. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance
which requires affected demolition, new construction and alteration projects to submit a Waste
Reduction plan and meet recycling requirements; any partial or full demolition of a structure,
interior or exterior, shall require a demolition permit;
10. that the project shall meet all the requirements of the California Building and Uniform Fire Codes,
2007 Edition, as amended by the City of Burlingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION
PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION
11. that prior to scheduling the framing inspection the project architect or residential designer, or
another architect or residential design professional, shall provide an architectural certification that
the architectural details shown in the approved design which should be evident at framing, such as
window locations and bays, are built as shown on the approved plans; architectural certification
documenting framing compliance with approved design shall be submitted to the Building Division
before the final framing inspection shall be scheduled;
12. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the
roof ridge and provide certification of that height to the Building Division; and
13. that prior to final inspection, Planning Division staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been built
according to the approved Planning and Building plans.
The motion was seconded by Commissioner Vistica.

Discussion of motion:
The Special Permit is necessitated by topographical conditions on the property, and assists in the
proper massing of the structure.
Chair Terrones called for a voice vote on the motion to approve. The motion passed 4-0-2-1.
(Commissioners Cauchi and Lindstrom absent, Commissioner Auran recused). Appeal procedures were
advised. This item concluded at 7:15 p.m.
Commissioner Auran returned to the dais.
Commissioner Yie indicated that she would recuse herself from participating on Agenda Item 2 (1021
Cortez Avenue) since she resides within 500-feet of the property. She left the Council Chambers.
2. 1021 CORTEZ AVENUE, ZONED R-1 — APPLICATION FOR DESIGN REVIEW FOR A NEW SINGLE
FAMILY DWELLING AND DETACHED GARAGE (FARSHID SAMSAMI, APPLICANT; KWANG PAK,
PROPERTY OWNER; AND SAMUEL K. WONG, ARCHITECT) STAFF CONTACT: RUBEN HURIN
Reference staff report dated August 10, 2009, with attachments. Community Development Director Meeker
presented the report, reviewed criteria and staff comments. Fifteen (15) conditions were suggested for
consideration.
Chair Terrones opened the public hearing.
Farshid Samsami, 200 Valley Drive, Brisbane; represented the applicant.
Commission comments:
■ Why are the brackets on the front elevation not evenly spaced? (Samsami — will look at the
situation and move the brackets to address the concern.)
■ A Magnolia tree is proposed in the front yard. There are other trees that could be of a similar height
that are cleaner. (Samsami — selected the species since there are a lot of Magnolias in the
neighborhood.)
■ What is the chimney finishing material? Perhaps bring back as an FYI. (Samsami — ledge stone is
proposed.)
■ On north elevation; does the chimney block the bedroom window? (Samsami — blocks a bathroom
window; will be an opaque window.)
■ Improvements to the project are good.
■ The rafter details appear somewhat conceptual; perhaps add some texture to the rooflines by
showing the rafter tails.
■ Porch looks great.
Public comments:

Additional Commission comments:
■ Consider revision to the chimney, selection of stone veneer and exposed rafter tail design, including
placement of rafter tails, as FYI items.
■ If the applicant selects a tree other than a Magnolia; include that revision on the FYI.
Commissioner Vistica moved to approve the application, by resolution, with the following amended
conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Division date
stamped August 3, 2009, sheets A-1 through A-6;
2. that the final design of the chimney, the material selection for the stone veneer, final design for the
exposed rafter tails; and final tree selection for the front, if other than a Magnolia, shall be submitted
and approved by the Planning Commission as an FYI item, prior to building permit issuance;
3. that the permeable paver driveway shall be installed as shown on the Landscape Plan and shall
follow the installation specifications shown on the detail titled "Permeable Pavement with Full
Exfiltration to Soil Subgrade" provided by the Interlocking Concrete Pavement Institute (ICPI), or
similar acceptable method to provide filtration into the soil subgrade approved by the Public Works
— Engineering Division;
4. that any changes to building materials, exterior finishes, windows, architectural features, roof height

12. that the project shall meet all the requirements of the California Building and Uniform Fire Codes,
2007 Edition, as amended by the City of Burlingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION
PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION
13. that prior to scheduling the foundation inspection, a licensed surveyor shall locate the property
corners, set the building footprint and certify the first floor elevation of the new structure(s) based on
the elevation at the top of the form boards per the approved plans; this survey shall be accepted by
the City Engineer;
14. that prior to scheduling the framing inspection the project architect or residential designer, or
another architect or residential design professional, shall provide an architectural certification that
the architectural details shown in the approved design which should be evident at framing, such as
window locations and bays, are built as shown on the approved plans; architectural certification
documenting framing compliance with approved design shall be submitted to the Building Division
before the final framing inspection shall be scheduled;
15. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the
roof ridge and provide certification of that height to the Building Division; and
16. that prior to final inspection, Planning Division staff will inspect and note compliance of the

3. 1613 EASTON DRIVE, ZONED R-1 — APPLICATION FOR DESIGN REVIEW AND SPECIAL PERMIT
FOR DECLINING HEIGHT ENVELOPE FOR A NEW, TWO-STORY SINGLE FAMILY DWELLING AND
DETACHED GARAGE (CHU DESIGN AND ENGINEERING, APPLICANT AND DESIGNER; AND BOB
AND CINDY GILSON, PROPERTY OWNERS) PROJECT PLANNER: ERICA STROHMEIER
Reference staff report dated August 10, 2009, with attachments. Associate Planner Strohmeier briefly
presented the project description. There were no questions of staff.
Chair Terrones opened the public comment period.
James Chu, 55 43d Avenue, San Mateo and Bob Gilson, 30 Woodgate Court, Hillsborough; represented
the applicant.
Commission comments:
■ What is the material used for the chimney caps? (Gilson — the caps are copper. Chu — could be
lower; particularly the one at the front which is "fake". The one at the rear may be a "real" fireplace
which would require the greater height to meet code.)
■ Consider removing one of the chimneys. The chimney design tends to make the project look
grandiose. (Gilson — could lower the one in front, bringing it down to the roofline, with a smoother
design at the top.)
■ House would benefit from a street tree; but design shows area for parking in front of the house;
suggests a street tree in this area. (Chu — showed a tree at the initial submittal; will look into adding
a tree in this location. Meeker — will discuss with the arborist and bring back as an FYI.)
■ Would be good to have a door into the house from the right side of the driveway. (Chu — no room
because of the required back up area for the garage.)
■ Like the use of the horizontal wood siding, but ensure that on the left elevation that the shingles will
turn back to the surface.
■ Clarify that windows will be "simulated" true divided light windows.
■ Consider placing a round opening on the chimney caps.
■ Be certain that the landscape architect looks closely at the tree choice in the front, given the
transition from the Eucalyptus to the dwarf Magnolia.
• Would be nice to have only a one car garage to provide more of a yard.
Public comments:
Charles Cleveland, 1274 Cortez Avenue; and Pat Giorni, 1445 Balboa Avenue; spoke:
■ Commends the project, but expressed concern about removal of the Monterey Pines; please
provide advance notice to the neighbors prior to removal.
■ Consider measures to serve as a barrier between the site and the adjacent properties during
construction to reduce impacts to privacy and dust.
■ During the project; there will be a fair amount of traffic; encouraged a parking plan during the
construction phase. (Terrones — front setback area could be used for staging.)
■ There is a sewer lateral that runs from his property along the west side of the property to Easton
Drive; there are other terra-cotta lines in the area; encouraged using this opportunity to have these
replaced coincident with the project, since they could be damaged during construction.
■ Ensure no windows on the rear of the garage to ensure privacy.

■ Don't want to encourage a lot of parking near the Eucalyptus trees; definitely check with the arborist
about another street tree.
■ Are "real" fireplaces still permitted? (Terrones/Brownrigg — yes.)
■ Lower the front chimney or remove it.
■ Is a good project.
There were no other comments from the floor and the public hearing was closed.
Additional Commission comments:
Require debris boxes on the site during demolition and construction.
Commissioner Brownrigg made a motion to place the item on the Consent Calendar when complete.

Require privacy screen during construction to project adjacent properties.
Seek Resolution of the sewer lateral issue.

4. 815 LAUREL AVENUE, ZONED R-1 — APPLICATION FOR DESIGN REVIEW FOR A FIRST AND
SECOND STORY ADDITION TO AN EXISTING SINGLE FAMILY DWELLING (DARYL BUCKINGHAM,
APPLICANT AND DESIGNER; AND PATRICIA DEL CHIARO, PROPERTY OWNER) STAFF CONTACT:
ERICA STROHMEIER
Reference staff report dated August 10, 2009, with attachments. Associate Planner Strohmeier briefly
presented the project description. There were no questions of staff.
Chair Terrones opened the public comment period.
Daryl Buckingham, 338 Ridge Road, San Carlos; represented the applicant.
Trying to keep the home simple and understated; encouraged a smaller plan than what was
proposed previously.
Commission comments:
Good design.
What is material for attic vent? (Buckingham — wood; will be built on site.)
Will entire roof be removed? (Buckingham — will keep the front portion of the roof; but will extend it
to join the addition.)

■ Call out the 6" x 10" beam ends; there is very little eave on the existing home. (Buckingham — will
be extending the eave.) Consider extending the eave even further; perhaps 5-6 inches; will create
a better shadow line.
■ Questioned the use of vinyl windows. (Buckingham — provided a window sample for review; these
windows were carried over from the prior plans to the revised plans.) Concerned more about the
environmental impact of vinyl windows; can generate toxins. There are better materials that could
be used. (Buckingham — will discuss with the homeowner and contractor.)
■ The proportion of the circular window seems awkward. (Buckingham — attempting to make the
window make sense; trying to balance it on the roofline.)
■ What is the detail that notches up on the second floor window? (Buckingham — made that section
taller to add detail to the window.)
■ The existing house is true to its time; the large, heavy fascias shown on the plans make the design
look flat; will there be gutters, and some breakdown of the fascias? (Buckingham — the barge
rafters will be cut down to align with the fascia.) Break down the fascia and render the gutters on
the plans.
■ Discuss window choices with the applicant and the contractor. Would want to make certain that the
simulated true divided light windows are available, if vinyl windows are selected.
■ Is there a column under the second -story window towards the front bedroom; is there a fin -wall?
(Buckingham — there is a fin -wall; if cut back, the roofline will hang out further and look awkward.)
Could provide a deeper overhang; look at this element of the design.
■ On rear elevation; a trellis is shown over the rear porch; is there a support for the center beam?
Look at the design.
■ Has any thought been given to the front entry to make it more inviting? (Buckingham — plan was to
build up the post and to provide new railing.)
■ Any thought to creating a porch? (Buckingham — attempting to retain most of the original front of
the house due to economic constraints.) Improving the design of the front porch would help to tie
the new construction to the original construction.
■ The garage isn't changing; but the door is changing, note indicates that the garage change is
optional. (Buckingham — may not be possible due to economic constraints.) Change to the top of
the garage door is not necessary, would permit a simpler door design; and allow more energy to be
put towards the porch.
■ On the second -story, right most window on "d" elevation; window doesn't fit the pattern.
(Buckingham — if 3 panes are provided, they would be huge.)
Public comments:
Pat Giorni, 1445 Balboa Avenue; spoke:
Noted street tree is a fruit tree; these have been removed from the street tree list; asked that
arborist be engaged again to review.
Suggestions of the Commission sound reasonable; sounds like the contractor is driving the design
by restricting costs.
There were no other comments from the floor and the public hearing was closed.
Commissioner Vistica made a motion to place the item on the Regular Action Calendar when complete.
This motion was seconded by Commissioner Auran.

windows.

and Lindstrom absent). The Planning Commission's action is advisory and not appealable. This item
concluded at 8:22 p.m.
5. 1428 CARLOS AVENUE, ZONED R-1 — APPLICATION FOR DESIGN REVIEW FOR A FIRST AND
SECOND STORY ADDITION TO AN EXISTING SINGLE FAMILY DWELLING (RAY BRAYER,
APPLICANT AND DESIGNER; AND JOHN AND JILL THOMAS, PROPERTY OWNERS) STAFF
CONTACT: ERICA STROHMEIER

presented the project description. There were no questions of staff.

Ray Brayer, 228 Lorton Avenue and John Thomas, 1428 Carlos Avenue; represented the applicant.
Commission comments:
■ Good design.
■ Add window detail and deck details.
■ Is new garage being pushed back on the property? (Brayer — yes.)
■ On front, is the lower wall a seat wall? (Brayer — yes.)
■ Provide details on trims, finishing, etc.
■ Is deck supported by posts? (Brayer — wishes to design it to be more grounded.)
Public comments:
None.

Commission Communications:

Actions from Regular City Council meeting of August 3, 2009:
There was no August 3, 2009 City Council Meeting.
FYI: 1212 Cabrillo Avenue — requested changes to a previously approved Design Review project:
Accepted.
FYI: Peninsula Hospital Complaint Log — July, 2009:
Accepted.
In response to an inquiry from the Commission regarding the frequency of complaints regarding the
hospital construction; Community Development Director Meeker indicated that he feels comfortable
that complaints are being resolved, particularly in light of the frequent meetings between residents
and the Mitigation Monitoring Panel assembled for the construction project.
Miscellaneous:
Staff was requested to schedule meetings of each of the Planning Commission Subcommittees.
Community Development Director Meeker indicated that he would do so; and provide a summary of topics
for each subcommittee. In some instances, work on subjects may be delayed pending adoption of the
Burlingame Downtown Specific Plan, but the affected subcommittees will at least have a sense for the work
on the horizon.
XII. ADJOURNMENT
