HomeMy WebLinkAboutReso - CC - 076-198410/16/34 that: RESOLUTION NO. 76-84 RESOLUTION AUTHORIZING ACCESS TO CRIMINAL HISTORY INFORMATION RESOLVED by the CITY COUNCIL of the CITY OF BURLINGAME WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) authorize cities, counties, and districts to access state and local summary criminal history information for employment, licensing, or certification purposes, and WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) requires that there be a requirement or exclusion from employment, licensing, or certification based on specific criminal conduct on the part of the subject of the record, and WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) -equire the City Council to specifically authorize access to summary criminal history information for employment, licensing, or certification purposes, NOW, THEREFORE BE IT RESOLVED THAT the City Attorney and Police Chief are hereby authorized to access summary criminal tory information for employment, licensing, or certification , and BE IT FURTHER RESOLVED THAT the City of Burlingame shall consider a person who has been convicted of a felony or a sdemeanor involving moral turpitude eligible for employment or sing; except that such conviction may be disregarded if it is that mitigating circumstances exist, or that the onviction is not related to the 1 or licen in question.
