ROLL CALL Present: Chair Batte, Commissioners Bauer, Chu, and Kirchner Absent: Commissioner Khoury Staff: Parks and Recreation Director Glomstad, Parks Supervisor Burow, and Recording Secretary Flores Others: None MINUTES Commissioner Kirchner made a motion to approve the September 5, 2024, Regular Meeting minutes. The motion was seconded by Commissioner Chu and was approved. 4-0-1 CORRESPONDENCE None PUBLIC COMMENT None PRESENTATION None OLD BUSINESS None NEW BUSINESS 1. City Council Presentation of Landscape Awards Discussion Director Glomstad confirmed with the Commissioners that the 2024 Landscape Awards would be presented at the City Council meeting on October 21, 2024. Commissioner Kirchner stated that he would complete the PowerPoint presentation and the window decals. Also, he stated that he reached out to Mayor Colson about commissioning a watercolor painting for the Business Landscape Award winner and would follow up to see if that would be ready for the presentation. REPORTS Supervisor Burow reported that the Fall Street Tree Planting will begin the week of October 7, 2024, and 250 trees are expected to be planted through the beginning of November. She confirmed that the new trees will be sufficiently watered to ensure they survive until the rainy season begins. She reported on contract tree work underway around the city; the first was Mario’s Tree Service, working on California Drive near the donut shop and then moving to El Camino Real near the hospital. Also, WCA is working on the routine grid pruning. She stated that utility conflict removal work will be done through PG&E and homeowners will be noticed. Supervisor Burow confirmed that Arborist Holtz will present the Tree Ordinance Update 2 at the October 21, 2024, City Council meeting. The Cuernavaca Field Renovation Project and the Mills Canyon Landslide Repair Project will be finished by the end of the month. Secretary Flores stated that there was a tentative ribbon cutting date scheduled for the Cuernavaca Field Renovation for Monday, November 4, 2024, at 3:30 PM, with confirmation to follow. Also, the Burlingame Mobility Hub ribbon cutting was tentatively scheduled for Thursday, October 24, 2024, at 1 PM. Lastly, she reported that the Town Square public bid closed, and the City received four bids. Director Glomstad confirmed that the construction contract would also be presented at the City Council meeting on October 21, 2024. UPCOMING AGENDA ITEMS Director Glomstad stated that Jennifer Pfaff would be presenting the Ansel Mills Easton’s Burlingame Railway Company panel to the Commission at the December meeting. She also commented on the Trees of Burlingame publication and inquired if we were ready to bring the content back to a future meeting. Commissioner Kirchner confirmed a few updates are required on photographs and a map before it is ready for publication. Director Glomstad suggested it be brought back on the December agenda as well. Commissioner Chu inquired about engaging with the community to ensure tree watering needs are being monitored. Director Glomstad stated that the Adopt-A-Tree program was established through the Commission and staff many years back. She asked Secretary Flores to send content information about the program to the Commissioners and have the item agendized in the New Year for discussion and updates. Respectfully submitted, Veronica Flores Veronica Flores Recording Secretary 1 STAFF REPORT To: Beautification Commission Date: November 7, 2024 From: Richard Holtz, Parks Superintendent/City Arborist Subject: Public Hearing to Consider an Appeal of the City Arborist's Approval of the Removal of a Protected Private Tree at 2300 Adeline Drive RECOMMENDATION Staff recommends that the Commission review the City Arborist's decision to approve the removal of a privately protected tree at 2300 Adeline Dr. The Commission can either: 1. Uphold the City Arborist’s decision. 2. Reject the City Arborist's decision. 3. Request more information to be able to make a determination. BACKGROUND The Sisters of Mercy (SOM) is the largest privately owned property in Burlingame and is home to over 1,700 trees. The SOM property is largely open to the public, allowing visitors and neighbors to walk through the grounds on numerous walking trails. During the extreme storms of 2023, the SOM property experienced dozens of tree failures. In 2024, SOM contacted the City of Burlingame on April 23 & 30, July 12, September 3 and October 30 to notify staff about large tree and limb failures requiring emergency tree work. The emergency response was required on multiple occasions and dictated a thorough follow-up on significantly sized trees on the property. On July 31, 2024, the City Arborist was contacted by the SOM regarding their private protected trees. They informed the City Arborist of their plan to remove trees of concern and prune others that are candidates for retention following a certified arborist’s assessment. On September 5, 2024, the independent arborist’s report and recommendations were submitted to the City Arborist (Exhibit A). 75 protected-size trees have been recommended for phased removal. This represents 4.2% of the total tree population. A site meeting was held between the City Arborist, SOM, and their selected tree contractor on September 23, 2024. Trees of concern were viewed and discussed by the parties. The City Arborist recommended that the SOM prioritize the removal of the trees of greatest concern. On October 9, 2024, an application for the removal of one large Monterey cypress tree and two smaller dead tree trunks was received (Exhibit B). Only the large live tree was included in the public notification sent on October 22, 2024, as the dead existing trunks are not appealable. Appeal of protected Tree Removal at 2300 Adeline Drive November 7, 2024 2 The independent arborist report submitted identifies the subject of the application as Tree #162. The tree is adjacent to a walkway that has frequent pedestrian traffic. The report characterizes a failure as imminent, with consequences of impact being severe. Given this information and the City Arborist’s verification of decay, recent failures, and poor vigor, the City Arborist approved the removal and replacement of this tree in accordance with Burlingame Municipal Code Chapter 11.06 (Exhibit C) An appeal was received via email from a resident on October 28, 2024 (Exhibit D). DISCUSSION Monterey Cypress Trees The Monterey Cypress tree is native to the Central Coast of California. It performs best in the Pacific Coast environment. The growth of this species outside of its ideal climate can contribute to the premature decline of the tree. The species has a natural form that contributes to a branching structure with a heavy end weight. This creates a lever effect on heavy branches that can experience failure at higher rates than other similar-sized species. This particular specimen is a multi-trunk tree of five large stems. Two stems have been removed later in the tree’s life. Those previous points of attachment show decay and lack of response growth typically associated with healthy recovery. Two of the remaining three stems have evidence of multiple branch failures. The entire canopy lacks vigor and is experiencing dieback typical of mature specimen reaching the end of its lifecycle (Exhibit E). Reason for the Appeal to the Removal of the Tree Staff requested the reasons for the appeal from the appellant. As of the publishing of this staff report, no response has been received. The applicant has provided the necessary data to support removing and replacing the Monterey cypress tree per Burlingame's Municipal Code Chapter 11.06.060 criteria. The City Arborist viewed the tree in question and confirmed the existence of site conditions conducive to replacement. The recommended removal and replacement of this tree is based upon the increased risk of failure, the consequences of a potential failure, and the observed site conditions. Observations We completed a campus-wide inventory of trees and wood shrubs on site in February of 2024. A Basic Tree Risk Assessment was completed for all trees that were of sufficient size to prove a threat to people of uses of the site. Our compete inventory included 1746 individual trees and 803 individual or groups of shrubs. All trees were also located on site using precision GPS and their locations were mapped. Of these trees, 75 Protected Trees were recommended for removal. This constitutes about 4.2% of the total tree population. The data for the relevant trees and a map of the locations is attached. Discussion Many of these trees are large overmature specimens that are declining. Many were likely relics from before the site was developed or were original plantings from the time of development. The site hosts extensive natural regeneration and the residents take an active interest in cultivating new trees on site. Given that a large sitewide inventory has not been completed recently, the proportion of recommended removals is relatively small. Tree removals have been prioritized by risk level and should proceed in that order. Recommendations We recommend that the listed trees be permitted for removal and be replaced on site with 24” box trees. Removals should proceed in the order of risk listed in the data table. Clients may choose to accept or disregard the recommendations of the arborist, or to seek additional advice. Arborists cannot detect every condition that could possibly lead to the structural failure of a tree. Trees are living organisms that fail in ways we do not fully understand. Conditions are often hidden within trees and below ground. Arborists cannot guarantee that a tree will be healthy or safe under all circumstances, or for a specified period of time. Likewise, remedial treatments, like any medicine, cannot be guaranteed. Treatment, pruning, and removal of trees may involve considerations beyond the scope of the arborist’s services such as property boundaries, property ownership, site lines, disputes between neighbors, and other issues. An arborist cannot take such considerations into account unless complete and accurate information is disclosed to the arborist. An arborist should then be expected to reasonably rely upon the completeness and accuracy of the information provided. Trees can be managed, but they cannot be controlled. To live near trees is to accept some degree of risk. The only way to eliminate all risk associated with trees is to eliminate the trees. Tree risk assessment is not tree risk management. The arborist typically has the distinct and separate role of being the tree risk assessor. The tree risk manager is typically the property owner or the agent thereof. Tree risk management should consider tree risk management and may consider other factors related to property management decision making. approved. The large multi-trunk Monterey Cypress tree has been evaluated by a consulting arborist and recommended for removal. The tree is an overly mature tree that has already experienced significant branch failures. It is a multi-trunk tree that has two of five major stems removed over the years. The remaining co-dominant branches are weakly attached and have evidence of decay. The tree lacks vigor and has multiple areas of dieback in the canopy. This is typical of an overly mature Monterey Cypress in the retrenchment stage of its lifecycle. Therefore, I am approving removal of these trees based on the criteria in Chapter 11.06 of the Municipal Code, Urban Reforestation and Tree Protection Ordinance, section 11.06.060 which allows removal for the following reasons: (d) (1) the condition of the tree with respect to the proximity to existing or proposed structures, yards, driveway and other trees… and, (d)(7) the economic consequences and obligations of requiring a tree to remain. Replacement with ONE 24-inch box standard size single stem landscape trees (no fruit, nut, Japanese Maple, Palm, or Italian Cypress), verifiable by receipt, site observations and photographs, will be required to be planted anywhere on the private property as defined in Section 11.06.090. Replacement trees must have a mature height of over 30 feet, planted in accordance with industry standards, including irrigation and double staking. Adjacent property owner(s) within 300 feet of the property listed above are also receiving notification of this decision.
