HomeMy WebLinkAboutReso - CC - 120-2024 RESOLUTION NO. 120-2024 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING THE TENTATIVE AND FINAL PARCEL MAP (PM 24-03) FOR CONDOMINIUM PURPOSES, SUBDIVISION OF LOT 5, BLOCK 6, MAP OF EASTON ADDITION SUBDIVISION AT 1029 CAPUCHINO AVENUE; CEQA DETERMINATION: EXEMPT PURSUANT TO STATE CEQA GUIDELINES 15061 (B)(3) The City Council of the City of Burlingame resolves as follows: WHEREAS, the legal description for this map action is a subdivision of Lot 5, Block 6, Map of Easton Addition Subdivision; and WHEREAS, Burlingame Municipal Code Chapter 26.08 governs the process of approval of tentative and final maps; and WHEREAS, at their August 26, 2024 meeting, the Planning Commission reviewed and recommended approval of the tentative map; and WHEREAS, the Public Works Department has reviewed the above-described tentative and final map and recommends that the City Council approve the above-described tentative and final map with the following conditions: 1. A final parcel map for the lot split must be filed by the applicant within the two-year time period as allowed by the Subdivision Map Act and the City’s Subdivision Ordinance (Chapter 26.08 of the Burlingame Municipal Code, as may be amended). 2. All property corners shall be set in the field and be shown on the map. 3. The final map shall show the widths of the right-of-way for Capuchino Avenue, Carmelita Avenue, and Sanchez Avenue, including the centerlines of right-of-way, existing private culvert through the parcel, bearings, and distances of centerline and any existing monuments in the roadway. 4. All damaged sidewalk, curb and gutters shall be replaced with new. 5. The conditions, covenants, and restrictions for the map shall be in a form acceptable to the City Attorney and shall conform to all approved conditions and City codes. 6. No raised structures shall be constructed in the public rig ht-of-way. 7. Permanent stormwater treatment measures are required for this project and the property owner must enter into an operation and maintenance agreement with the City to maintain the proposed bioretention areas on private and public right-of-way (by means of a separate special encroachment permit). This action is exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guideline section 15601(b)(3), as it can be seen with certainty that approval of the final map will not have an impact on the environment. 2. The final map (PM 24-03) for 1029 Capuchino Avenue is approved with the conditions described above. 3.
