HomeMy WebLinkAboutReso - CC - 119-2024 RESOLUTION NO. 119-2024 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING THE VESTING TENTATIVE MAP (PM 23-05), LOT COMBINATION OF LOTS 1, 2, 3, 4 AND 5, BLOCK 7, MAP OF EAST MILLSDALE INDUSTRIAL PARK NO. 2 SUBDIVISION AT 1499 OLD BAYSHORE HIGHWAY; CEQA DETERMINATION: EXEMPT PURSUANT TO STATE CEQA GUIDELINES 15061(B)(3) The City Council of the City of Burlingame resolves as follows: WHEREAS, the legal description for this map action is a lot combination of Lots 1, 2, 3, 4 and 5, Block 7, Map of East Millsdale Industrial Park No. 2 Subdivision; and WHEREAS, Burlingame Municipal Code Chapter 26.08 governs the process of approval of tentative and final maps; and WHEREAS, at their April 8, 2024 meeting, the Planning Commission reviewed the development and recommended City Council approval of the vesting tentative map; and WHEREAS, the Public Works Department has reviewed the above-described vesting tentative map and recommends that the City Council approve the above-described vesting tentative map with the following conditions: 1. All frontage sidewalks, driveways, and curb and gutter within the public right-of-way shall be replaced with new improvements. 2. The existing structures must be demolished before the map can be recorded. 3. No raised structures shall be constructed in the public right-of-way. 4. A final parcel map must be filed by the applicant within the two-year time period as allowed by the Subdivision Map Act and the City’s Subdivision Ordinance. 5. Proposed abandonment of public utility easement must be approved prior to map recordation and all relocation of existing utilities shall be undergrounded per the Burlingame Municipal Code. 6. No developmental approvals are part of this mapping action. 7. All property corners shall be set in the field and be shown on the map. 8. The final map shall show the widths of the right-of-way for Old Bayshore Highway and Mahler Road including the centerlines of right-of-way, bearings and distances of centerline, and any existing monuments in the roadway. 9. Project shall dedicate public pedestrian access and maintenance access easements surrounding the project site. Ownership and maintenance shall remain with the Docusign Envelope ID: 295EEB73-5AC5-44EA-99B2-2DC2D43ED523 development. 10. Permanent stormwater treatment measures, and operation and maintenance agreement are required for the parcel. Permanent stormwater treatment measures in the public right- of-way that are triggered by the project will be maintained by the development through a special encroachment permit agreement. Owner Agreements shall be recorded with the County prior to building permit sign-off. 11. Project shall enter into a subdivision improvement agreement or equal to incorporate/construct improvements per the Old Bayshore Highway Streetscape Master Plan. 12. Parcel is within the special flood hazard zone and will require FEMA compliance with submittal of an approved FEMA LOMR-F, elevation certificate(s), and flood certificate(s) (if applicable) prior to building permit sign-off. NOW, THEREFORE BE IT RESOLVED, DETERMINED AND ORDERED BY THE COUNCIL, AS FOLLOWS: 1. This action is exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guideline section 15601(b)(3), as it can be seen with certainty that approval of the vesting tentative map will not have an impact on the environment. 2.
