A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AUTHORIZING
THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AMENDMENT TO THE
AGREEMENT WITH CBRE AND TO INCREASE THE NOT-TO-EXCEED AMOUNT BY
$88,240 AND INCREASE THE GENERAL FUND BUDGET APPROPRIATION FOR THE CITY
MANAGER’S OFFICE BY $88,240
WHEREAS, the City Council has a long-standing goal of constructing or purchasing a new
facility to meet the needs of the community, City Council, and staff; and
WHEREAS, after the City Council’s 2023 goal-setting session, the City Council established
the City Hall Ad-Hoc Subcommittee to explore the financing and construction/purchase of a new
City Hall; and
WHEREAS, on June 20, 2023, the City issued a Request for Proposals (RFP) soliciting
consultant assistance from an architecture firm and a real estate advisor for the new City Hall
project; and
WHEREAS, in August of 2024, the City selected Group 4 Architecture (Group 4) as its
architect and Keyser Marston Associates (KMA) as its real estate advisor; and
WHEREAS, Group 4 and KMA have completed significant work in evaluating the City’s
needs for a new City Hall and potential sites for a new City Hall; and
WHEREAS, in addition to exploring sites to construct a new City Hall, the Ad -Hoc
Subcommittee directed staff to research existing office space that may serve as a new City
Hall; and
WHEREAS, on March 8, 2024, the City issued an RFP seeking a commercial real
estate broker to identify available commercial real estate in Burlingame that meets the City’s
needs for a new City Hall; and
WHEREAS, staff identified CBRE as the preferred broker, due to CBRE’s extensive
experience in the local real estate market and experti se in completing transactions for local
agencies; and
WHEREAS, on May 7, 2024, the City executed an agreement with CBRE for
commercial real estate broker services; and
WHEREAS, if the City identifies existing commercial office space that may serve as
the new City Hall, through a due diligence process, the City must inspect the structure of the
building and the land to ensure both are in good condition; and

WHEREAS, CBRE possess experience with conducting due diligence and has
familiarity with experts to assist with the due diligence process; and
WHEREAS, the original Agreement’s more limited scope resulted in a lower do-not-
exceed amount, and an increase is needed for both this amount and the City Manager’s Office’s
Budget Appropriation to allow for the contracting of these necessary services; and
WHEREAS, if CBRE identifies any issues that requires further investigation during the
due diligence process, the City will negotiate with CBRE for additional investigative services.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME
RESOLVES AS FOLLOWS:
The City Manager is authorized to negotiate and execute an Amendment to the professional
services agreement with CBRE in accordance with the recitals above. Further, the City Manager
is authorized to negotiate and execute additional amendments to the scope of work of the
Agreement without approval of the City Council, so long as any additional work is in the spirit of
the prior agreements, and the cost of any additional work is not in excess of the not -to-exceed
amount of the proposed Agreement.

day of September, 2024, and was adopted thereafter by the following vote:
