A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AUTHORIZING THE
CITY MANAGER TO NEGOTIATE AND EXECUTE AN AMENDMENT TO THE AGREEMENT
WITH KEYSER MARSTON ASSOCIATES TO INCREASE THE NOT-TO-EXCEED AMOUNT BY
$60,000 AND TO INCREASE THE GENERAL FUND BUDGET APPROPRIATION FOR THE
CITY MANAGER’S OFFICE BY $35,000
WHEREAS, the City Council has a long-standing goal of constructing or purchasing a new
City Hall facility to meet the needs of the community, Council, and staff; and
WHEREAS, after the Council’s 2023 goal-setting session, the City Council established the
City Hall Ad-Hoc Subcommittee to explore the financing and construction of a new City Hall; and
WHEREAS, on June 20, 2023, the City issued a Request for Proposals soliciting consultant
assistance from an architecture firm and a real estate advisor for the new City Hall project; and
WHEREAS, on August 22, 2023, the City executed an agreement with Keyser Marston
Associates, Inc. (KMA) for real estate advisor services for development, construction, and financing
related to the new City Hall; and
WHEREAS, KMA completed its review of City-owned real property, review of privately-
owned real property, creation of a new City Hall financing plan, and review of the financial feasibility
of multiple City Hall sites; and
WHEREAS, on May 31, 2024, the Agreement with KMA expired; and
WHEREAS, on September 3, 2024, the City Council approved a new Agreement with KMA
for real estate advisor services; and
WHEREAS; on September 4, 2024, the City entered into that new Agreement with KMA to
extend the term of the agreement until March 3, 2025; and
WHEREAS; the City desires to retain KMA to participate in real estate negotiations for
existing office space identified by the City as suitable for a new City Hall and, if necessary, to
provide advice related to the lease and/or sale of City property; and
WHEREAS; the original Agreement’s limited scope resulted in a lower do-not-exceed
amount, and an increase is needed for both this amount and the City Manager’s Office’s Budget
Appropriation to allow for the contracting of these necessary services; and
WHEREAS, staff is pleased with the work product provided by KMA.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME RESOLVES
AS FOLLOWS:
The City Manager is authorized to negotiate and execute an Amendment to the professional
services agreement with KMA. Further, the City Manager is authorized to negotiate and execute
additional amendments to the scope of work of the Agreement without approval of the City
Council, so long as any additional work is in the spirit of the prior agreements, and the cost of any
additional work is not in excess of the not-to-exceed amount of the proposed Agreement.

Resolution was introduced at a regular meeting of the City Council held on the 16th day of
September 2024, and was adopted thereafter by the following vote:
