HomeMy WebLinkAboutReso - CC - 111-2024 RESOLUTION NO. 111-2024 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING THE VACATION OF PUBLIC UTILITY EASEMENTS, WIRE CLEARANCE EASEMENTS, AND AN ANCHOR EASEMENT AT 1499 OLD BAYSHORE HIGHWAY WHEREAS, the City of Burlingame, pursuant to Streets and Highways Code Section 8300, et seq. is authorized to vacate utility easements; and WHEREAS, the developer of the property has requested to vacate the easements in preparation for a lot combination to construct an eight-story lab/office building and a seven-story garage with new improvements extending over the easements; and WHEREAS, a Notice of Public Hearing to consider the vacation of public utility easements was published in the San Mateo Daily Journal for at least two successive weeks prior to the public hearing, and four copies of the public notice were posted in the vicinity of the utility easements to be vacated, pursuant to Sections 8320-8325 of the Streets and Highways Code; and WHEREAS, letters of consent from AT&T and PG&E have been obtained, and no written objections for the vacation of easements have been received; and WHEREAS, as required, on September 3, 2024, the City Council held a public hearing on the proposed vacation of easements and heard evidence and testimony from all persons interested. NOW, THEREFORE, BE IT RESOLVED: 1. Vacation of the public utility easements, wire clearance easements, and an anchor easement are in conformity with Sections 8320-8325 of the Streets and Highways Code. 2. The City Council finds, from all the evidence submitted, that the easement is unnecessary for present or prospective public use and thereby approves vacation of said easement. 3.
