RESOLUTION NO. 119-85
RESOLUTION APPROVING VARIANCE
RESOLVED by the CITY COUNCIL of the City of Burlingame
WHEREAS, application has been made for a variance to
second floor side yard setback requirements for an addition to
21 Arundel Road (APN 029-291-130), and
WHEREAS, the Planning Commission held a public hearing
on said application on September 10, 1985, at which time said
application was approved;
WHEREAS, this matter was appealed to Council and a hearing)
thereon held on October 7, 1985;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by
this Council that said variance is approved, subject to the
findings set forth in Exhibit "A" and the conditions set forth
in Exhibit "B" attached hereto.
It is further directed that a certified copy of this
resolution be recorded in the official records of the County of
San Mateo.
Pursuant to Section 11094.6 of the Code of Civil Procdure,
any judicial review of this decision must be inititated within
ninety (90) days of this resolution.

EXHIBIT "A"
FINDINGS IN SUPPORT OF VARIANCE
1. Exceptional circumstances exist due to the sub -standard forty-
five foot width of the lot, thereby limiting the amount of
development in the absence of a variance. Such circumstances
also exist in that constructing to a five foot setback and
maintaining proper garage width would require substantial and
expensive modifications to the existing building.
2. The owner's property rights would be preserved by allowing him
to build to the same extent as a standard width lot.
3. The granting of said variance will not be detrimental to the
public health, safety and welfare, or injurious to others because
a 9 inch variance has no substantial effect on the addition's
visual or other impacts on other properties.
4. The granting of this variance will not effect the comprehensive
zoning plan of the City since the use remains single family.
