RESOLUTION NO 147-90
RESOLUTION APPROVING HILLSIDE AREA CONSTRUCTION PERMIT
2800 MARIPOSA DRIVE
RESOLVED, by the City Council of the City of
Burlingame that:
WHEREAS, application was made to the Planning
Commission of the City of Burlingame by Vasilios Sianis for
a hillside area construction permit for 2800 Mariposa Drive;
and
WHEREAS, said application was heard by the
Planning Commission of the City of Burlingame on October 22,
1990, said hearing being properly noticed as required by
law; and
WHEREAS, the permit was approved by the Planning
Commission, a timely appeal filed, and a public hearing upon
said appeal scheduled and held by the City Council on
December 4, 1990:
NOW, THEREFORE, IT IS ORDERED AND DETERMINED by
the City Council of the City of Burlingame:
1. That the following findings are made regarding
said application:
(a) Each application must be taken on its merits. The
extent of the impact on distant views, not just that there
will be an impact, must be considered. The significance of
the impact on all neighbors must be considered. This
decision is made on the merits of this application alone and
is not to be considered as a precedent of any kind.'
(b) The application of Vasilios Sianis is for the
construction of a 1,225 square foot second story on an
existing residence at 2800 Mariposa Drive (A.P.N, 025-072-
010), as more fully described on the plans submitted to the
Planning Department and date stamped October 16, 1990.
(c) The granting of the permit applied for will be in
the interests of the health and welfare of the persons in
the vicinity of said property and of the City of Burlingame,
and would be in conformity with reasonable and orderly use
of the property because:
(1) Construction of the second story as proposed
will obstruct only a minor portion of existing distant views
from neighboring properties;

(2) The proposed second story addition has been
mitigated to the greatest extent possible, particularly as
actually viewed from the breakfast room and living room of
2809 Las Piedras Drive, the residence most directly
affected.
3. The decision of the Planning Commission is hereby
upheld and the hillside area construction permit for 2800
Mariposa Drive, including the conditions attached hereto as
Exhibit "A", is granted.
4. It is further directed that a certified copy of
this resolution be recorded in the official records of the
County of San Mateo.

Burlingame, do hereby certify that the foregoing resolution
was introduced at a regular meeting of the City Council held
on the 4th day of December, 1990, and was adopted thereafter

1. that the addition as built shall conform to the plans submitted
to the Planning Department and date stamped September 27, 1990
except that the cantilever of the new second floor at the front
of the house shall overhang a maximum of 4" as shown on the plans
date stamped October 16, 1990;
2. that the finish material used on both the flat and sloping
portions of the roof shall be nonreflective as approved by the
Chief Building Inspector and City Planner; and
3. that the highest point on the new roof of the remodeled house
shall not exceed elevation 137.221 and that the framing shall be
surveyed to confirm this elevation and the survey accepted by the
City Engineer before the final framing inspection is called for
and the roofing material is attached.
