RESOLUTION APPROVING SPECIAL PERMITS
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, application has been made for two special Permits
for heiaht and three special Permits for exceptions to the Bayfront
Design Guidelines for front setback shoreline setback and,
landscaping in order to build a 300 room hotel at 460 Airport
Boulevard, (APN 026-363-560 & Portions 026-363-540/550/570)and
WHEREAS, the Planning Commission held a public hearing on
said application on October 9 1990 at which time
said application was denied;
WHEREAS, this matter was appealed to Council and a
hearing thereon held on November 19 1990 at which
time it reviewed and considered the staff report and all other

written materials and testimony presented at said hearing;

NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this
to
Council that said special permits are approved, subject to the

conditions set forth in Exhibit "A" attached hereto.
It is further directed that a certified copy of this
resolution be recorded in the official records of the County of San
Mateo.

EXHIBIT "A"
Conditions of approval, 300 room
hotel, 460 Airport Boulevard
(effective November 20, 1990)
Property owner:

1. that the final building plans and construction of the
project shall be consistent with the plans submitted to the
Planning Department and date stamped August 31, 1990 and a
tentative parcel map submitted and date stamped August 17,
1990;
2. that the requirements of the Fire Marshal's August 24, 1990
memo and the City Engineer's September 4, 1990 memo shall be
met;
3. that the applicant shall receive a building permit for this CD
hotel by October 1, 1992 and commence construction by 0
December 15, 1992 with final inspection called for no later Ln
than February 1, 1994, one-half the bayfront development fee CD
will be paid at the time of final framing and before
February 1, 1994;
4. that the developer shall receive a BCDC permit and all
permits from other required reviewing agencies, state and
federal, including the State Lands Commission approval of
the leasehold line and necessary cross easements before a
building permit shall be issued by the City of Burlingame;
5. that the leaseholder shall grant appropriate access and use
easements to the adjacent leaseholder at 480 Airport
Boulevard for development and maintenance of the plaza area
at the leasehold line on the bay side of the site, for the
portion of the 17' wide perpendicular public access area
from Airport Boulevard to the Bay Plaza area and for 15'
along the leasehold line at the driveway onto Airport
Boulevard from the 480 Airport Boulevard site;
6. that until development occurs the leaseholder shall
hydroseed and groom the vacant site with native grasses to
reduce wind erosion and improve public safety; fence the
entire area outside the easements leaving a 25' setback from
top of bank'along the bay's and channel's edge; and trim and
maintain the vegetation along Airport Boulevard, until the
site is to be developed;
7. that the developer of 460 Airport Boulevard shall obtain an
easement from the adjacent leaseholder at '480 Airport
Boulevard of sufficient size to allow the new shoreline
protection structure to be extended the length of the bay
and channel shoreline (1,116 lineal feet) of the 8.8 acre
area, the completed structure shall conform to, the public
access plan submitted to the Planning Department and date
stamped August 31, 1990 and the developer shall build this
entire structure prior to having a final framing inspection
for the hotel at 460 Airport Boulevard;
8. that the main driveway to the hotel shall be aligned with
the driveway to the offices across Airport Boulevard and the
leaseholder or developer shall pay their share of the
signalization of this intersection when it is required in
the future as well as pay one-sixth the costs of the
widening of the bridge across Sanchez Channel;
9. that the median strip in Airport Boulevard shall be
realigned in order to establish a left turn lane onto the
site;
10. that the findings and recommendations of the geotechnical
study and any subsequent soils reports shall be reviewed by
the city and incorporated into the design and review of all C
structures and particular attention shall be paid to design 1,
addressing settlement and seismic stability, based on this N
review the city shall determine the proper foundation and W
support systems for all structures and require a pile V
foundation for the 300 room hotel; 63
11. that subsurface soil sampling shall be done along the
shoreline of the bay and channel and appropriate bank
stabilization measures implemented to ensure slope stability
including a 501 setback from top of bank for all structures
to avoid building in areas subject to cracking;
12. that the existing shoreline protection structure shall be
rebuilt to permanently control erosion and flooding as
proposed in the project plans including providing 85, of
sheet piles in the plaza area to define the shoreline of
this public access area, the remainder of the shoreline
including Sanchez Creek will be protected by the rebuilt 2:1
slope, this work should be coordinated with U.S. Army Corps
of Engineers;
13. that voids between the rubble face of the new shoreline
protection structure shall be filled with rock and cobble
ranging from 6" to 12" in diameter intermixed with shell and
small gravel as recommended by the California Department of
Fish and Game to enhance shellfish and other aquatic
habitat;
14.
that the San Mateo County Mosquito Abatement District shall
review all water features to determine if, as designed, they
will create a habitat for mosquitos; if so, the features
should be redesigned to address this agency's concerns;
15.
that the developer shall comply with the city mandated hours
of construction including driving piles as they are adjusted
by the needs of the neighboring businesses and impacted
residents across the freeway, the City Engineer shall be
responsible for reviewing the proposed hours and, if
necessary, adjusting the hours of construction while work is
in progress, pile drivers shall be shrouded and noise
barriers placed around the site sufficient to reduce general
construction noise by 5 dBA;
16.
that an acoustical analysis shall be required to demonstrate
interior noise levels will not exceed 45 dBA CNEL and all
requirements of Title 24 shall be met;
17.
the City Engineer shall review provisions for dirt and dust
control during construction including impacts on the storm
sewer collection system prior to issuing grading or any
other permit for construction, dust emissions shall be
reduced by 50% and shall comply with any additional
requirements determined by the city to be necessary for dust

that oil -water separators and sand trap catch basins shall

be installed in the runoff discharge line to the bay and to

the city's 36" storm sewer line, these facilities shall be

regularly maintained by the property owner or his designee,
water shall not stand on site or flood from this site onto
adjacent properties;
19. that landscaping shall include as many nativeCalifornia
plants as possible which require minimum fertilization and
pest control, guidelines for proper fertilization, pest
control, irrigation and plant lists shall be prepared and
approved by the Director of Parks, and landscape and
irrigation plans consistent with water conservation
guidelines shall be approved by the Director of Parks prior
to issuing a building permit;
20. that the project shall be required to comply with the San
Francisco Regional Water Quality Control Board permit
requirements for discharge into San Francisco Bay and any
additional requirements imposed by the city when these
standards become effective;
21. that the hotel operator shall participate in the cityts
transportation systems management program including employee
programs for carpooling, vanpooling, hotel shuttle pickup of
employees at local mass transit stations and other programs
and fees mandated by the cityfs program;
22. that shuttle service to and from San Francisco International
Airport shall be provided for guests as well as to the
CalTrain depot for guests;
23. that no more than 10% of the required parking stalls shall
be used for valet parking after a permit for valet parking
is secured from the city and this service shall be provided
to hotel guests and visitors at no charge;
24. that siltation of the bay waters during construction shall
be controlled by limiting grading on site to the dry season,
installing sediment traps, placing rather than dropping
broken riprap on the shoreline and minimizing operation of
heavy equipment in the bayfront area;
25. that the hotel operator shall provide a private security
patrol to regularly patrol the hotel and public access area;
26. that sewage pretreatment facilities shall be provided on
site for all areas where food is prepared and these
facilities shall meet the standards of the San Francisco
Regional Water Quality Control Board and the City of
Burlingame including proper maintenance of all pretreatment
facilities;
27. that

29. that no room in the hotel shall be leased to a single
occupant or corporation for more than 29 days and that the
rooms and buildings shall not be used for permanent
residential purposes;
30. that the developer shall negotiate with the leaseholder at
410-430 Airport Boulevard and the State Lands Commission a
cross easement agreement providing the leaseholder at 410-
430 Airport Boulevard unrestricted access across the
leasehold/property at 460 Airport Boulevard to Airport
Boulevard for the patrons and employees of the restaurant
located on the ship in Sanchez Channel adjacent to the state
leasehold identified in Burlingame as 410-430 Airport
Boulevard; close the driveway access to 410-430 Airport
Boulevard from Airport Boulevard retaining the access from
460 Airport as the exclusive access to the leasehold parcel
at 410-430 Airport Boulevard, the developer shall provide
appropriate driveways and other connections designed to city
standards from Airport Boulevard; and
31. that no expansion of the use on this site including adding
valet parking, a car rental desk and/or use of any public
access or parking area for hotel related uses other than
public access uses intended for the areas shall occur
without amendment to this permit.

hotel, 460 Airport Boulevard
(effective November 20, 1990)

1. that the final building plans and construction of the
project shall be consistent with the plans submitted to the
Planning Department and date stamped August 31, 1990 and a
