RESOLUTION APPROVING SPECIAL PERMIT
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, application has been made for a special permit for
height within BCDC Jurisdiction in order to build a 151 room hotel
at 480 Airport Boulevard, (APN 026-363-520/530 and Portions of
026-363-540/550). and
WHEREAS, the Planning Commission held a public hearing on
said application on October 9 1990 at which time
said application was denied;
WHEREAS, this matter was appealed to Council and a
hearing thereon held on November 19 , 1990 , at which
time it reviewed and considered the staff report and all other
written materials and testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this
Council that said special permit is approved, subject to the
conditions set forth in Exhibit "A" attached hereto.
It is further directed that a certified copy of this
resolution be recorded in the official records of the County of San
Mateo.

EXHIBIT "A"
Conditions of approval, 151 room hotel,
480 Airport Boulevard (effective November 20,
1990)

1. that the final building plans and construction of the
project shall be consistent with the plans identified for
Hotel A and submitted to the Planning Department, date
stamped August 31, 1990 and a tentative parcel map submitted
and date stamped August 17, 1990;
2. that the requirements of the Fire Marshal's August 23, 1990
memo and the City Engineer's September 4, 1990 memo shall be
met;
3. that the applicant shall receive a building permit for this
hotel by June 1, 1991 and commence construction by August 1,
1991 with final inspection called for no later than May 1,
1992, one-half the bayfront development fee will be paid at
the time of final framing and before March 1, 1992;
4. that the developer shall receive a BCDC permit and all
permits from other required reviewing agencies, state and
federal, including the State Lands Commission approval of
the leasehold line and all required cross and access
easements before a building permit shall be issued by the
City of Burlingame;
5. that the developer shall install and maintain the
landscaping, paving and improvements on the entire 3,000 SF
plaza area at the north end of the site including that
portion of the plaza located on the adjacent leasehold and
obtain all necessary easements for this improvement and
maintenance before receiving a building permit;
6. that the developer shall install and maintain the
landscaping, paving and other improvements on the 17, wide
perpendicular public access pathway from the Airport/Bayview
corner to the bayfront plaza including that portion of the
perpendicular access on the adjacent leasehold and the
pedestrian crosswalk at the entry drive to 480 Airport
Boulevard off Airport and obtain all necessary easements for
this improvement and maintenance before receiving a building
permit;

7. that the developer shall install and maintain a 151 deep
strip of landscaping on the 460 Airport site along the bay
side of the driveway/entrance to 480 Airport Boulevard from
Airport Boulevard and obtain all necessary easements for
improvement and maintenance of this area and get landscape
and irrigation plans approved by the Parks Department before
receiving a building permit;
8. that the developer of 480 Airport Boulevard shall obtain an
easement from the adjacent leaseholder at 460 Airport
Boulevard of sufficient size to allow the new shoreline
protection structure to be extended the length of the bay
and channel shoreline (1,116 lineal feet) of the 8.8 acre
area, the completed structure shall conform to the public
access plan submitted to the Planning Department and date
stamped August 31, 1990 and the developer shall build this
entire structure prior to having a final framing inspection
for the hotel at 480 Airport Boulevard;
9. that the developer at 480 Airport Boulevard shall obtain an
easement from the adjacent leaseholder at 60 Bayview Place
enabling this project to use the private.portion of Bayview
Place for access, the easement shall include obligations to
install and maintain street lighting as well as street
surfacing and maintenance resulting from the placement of
new utility lines and from increased use of the street by
traffic destined for the development at 480 Airport
Boulevard;
10. that the new leasehold line, consistent with the line
presented to the city in the tentative map date stamped
August 17, 1990: shall be established incorporating
appropriate and required cross easements for landscaping and
access/egress, and shall be approved by the State Lands
Commission and filed by the State Lands Commission staff
with the city before a building permit is issued;
11. that the developer obtain a BCDC permit prior to submitting
plans for a building permit, that the applicant shall meet
the conditions of the BCDC permit and that five public
access parking stalls shall be designated from the required
parking, location of the five parking, stalls to be
determined by BCDC;
12. that additional soils studies shall be completed and the
proposed structure and foundation including a pile
foundation evaluated by a structural engineer in light of
the soils information and the results reviewed and the
proper foundation selected with agreement of the Public
Works Director before a foundation system is selected and a
building permit is issued;
13. that until development occurs the leaseholder shall
hydroseed and groom the vacant site with native grasses to

reduce wind erosion and improve public safety; fence the
entire area leaving a 25' setback fron top of bank along the
bay's and channels edge; and trim and maintain all
vegetation including the vegetation along Airport Boulevard;
14. that the median strip in Airport Boulevard shall be
realigned in order to establish a left turn lane onto the
site;
15. that subsurface soil sampling shall be done along the
shoreline of the bay. and channel and appropriate bank
stabilization measures implemented to ensure slope stability
including a 501 setback from top of bank for all structures
to avoid building in areas subject to cracking;
16. that the existing shoreline protection structure shall be
rebuilt to permanently control erosion and flooding as
proposed in the project plans and approved by BCDC;
17. that voids between the rubble face of the new shoreline
protection structure shall be filled with rock and cobble
ranging from 6" to 12" in diameter intermixed with shell and CD
small gravel as recommended by the California Department of 0
Fish and Game to enhance shellfish and other aquatic u1
habitat; W

18. that the San Mateo County Mosquito Abatement District shall N
review all water features to determine if, as designed, they
will create a habitat for mosquitos; if so, the features
should be redesigned to address this agency's concerns;
19. that the developer shall comply with the city mandated hours
of construction including driving piles as they are adjusted
by the needs of the neighboring businesses and impacted
residents across the freeway, the City Engineer shall be
responsible for reviewing the proposed hours and, if
necessary, adjusting the hours of construction while work is
in progress, pile drivers shall be shrouded and noise
barriers placed around the site sufficient to reduce general
construction noise by 5 dBA;
20. that an acoustical analysis shall be required to demonstrate
interior noise levels will not exceed 45 dBA CNEL and all
requirements of Title 24 shall be met;
21. the City Engineer shall review provisions for dirt and dust
control during construction including impacts on the storm
sewer collection system prior to issuing grading or any
other permit for construction, dust emissions shall be
reduced by 50% and shall comply with any additional
requirements determined by the city to be necessary for dust
and erosion control during construction;
22. that oil -water separators and sand trap catch basins shall
be instilled in the runoff discharge line to the bay and to
the city's 36" storm sewer line, these facilities shall be
regularly maintained by the property owner or his designee,
water shall not stand on site or flood from this site onto
adjacent properties;
23. that landscaping shall include as many native California
plants as possible which require minimum fertilization and
pest control, guidelines for proper fertilization, pest
control, irrigation and plant lists shall be prepared and
approved by the Director of Parks, and landscape and
irrigation plans consistent with water conservation
guidelines shall be approved by the Director of Parks prior
to issuing a building permit;
24. that the project shall be required to comply with the San
Francisco Regional Water Quality Control Board permit
requirements for discharge into San Francisco Bay and any
additional requirements imposed by the city when these
standards become effective;
25. that the hotel operator shall participate in the city's
transportation systems management program including employee
programs for carpooling, vanpooling, hotel shuttle pickup of

employees at local mass transit stations and other programs
and fees mandated by the city's program;

26. that the hotel operator may use no more than 10% of the

required on-site parking spaces for valet parking and that

this service shall be provided free of charge for hotel
guests and visitors;
27. that shuttle service to and from San Francisco International
Airport shall be provided for guests as well as to the
CalTrain depot for employees and guests;
28. that siltation of the bay waters during construction shall
be controlled by limiting grading on site to the dry season,
installing sediment traps, placing rather than dropping
broken riprap on the shoreline and minimizing operation of
heavy equipment in the bayfront area;
29. that the hotel operator shall provide a private security
patrol to regularly patrol the hotel and public access area;
30. that sewage pretreatment facilities shall be provided on
site for all areas where food is prepared and these
facilities shall meet the standards of the San Francisco
Regional Water Quality Control Board and the City of
Burlingame and be properly maintained at all times;
31. that final landscape plans shall conform to the requirements
of the Bay Conservation and Development Commission's permit
and to the requirements of the State Lands Commission, and
that all these required facilities shall be installed, owned
and maintained by the developer;
32. that the project shall contribute its share to the one time
cost to expand the water mains;
33. that no room in the hotel shall be leased to a single
occupant or corporation for more than 29 days and that the
rooms and buildings shall not be used for permanent
residential purposes; and
34. that no expansion of the use on this site including adding a
restaurant facility, valet parking, a car rental desk, or
use of any public access or parking area for hotel related
uses other than public access uses intended for these areas
shall occur without amendment to this permit.

receiving a building permit;
8. that the developer of 480 Airport Boulevard shall obtain an
easement from the adjacent leaseholder at 460 Airport
Boulevard of sufficient size to allow the new shoreline
