AUTHORIZING RATE INCREASE AND AMENDING RECYCLING
AGREEMENT WITH BROWNING -FERRIS INDUSTRIES
RESOLVED by the CITY COUNCIL of the CITY OF
BURLINGAME, that
WHEREAS, on September 25, 1988, the City entered
into an agreement with BROWNING -FERRIS INDUSTRIES OF
CALIFORNIA for the collection and disposal of certain
recyclable materials accumulated within the City of
Burlingame, and
WHEREAS, by terms of said agreement BROWNING -
FERRIS INDUSTRIES has requested a surcharge increase, which
request has been duly considered and evaluated by this
Council,
NOW, THEREFORE, IT IS HEREBY DETERMINED AND
ORDERED that:
1. Under the terms of paragraph 17 of the agreement
between the CITY OF BURLINGAME and BROWNING -FERRIS
INDUSTRIES dated August 25, 1988, the BROWNING -FERRIS
INDUSTRIES has applied to this Council for a surcharge
increase.
2. This Council does hereby determine that the
surcharge hereinafter set forth is fair to the residents of
the City of Burlingame and is required to maintain a proper
operating ratio between collections and expenses.
3. A recycling surcharge of 3.85% shall apply
within the City of Burlingame.
4. Said surcharge shall be applied to all services
performed on or after October 1, 1989.
5. The City Manager be, and he is hereby, authorized
to sign said agreement for and on behalf of the City of
Burlingame.
6. The City Clerk is hereby ordered and instructed
to attest such signature.

Burlingame, do hereby certify that the foregoing resolution
was introduced at a regular meeting of the City Council
held on the 4th day of December , 198 9 and
was adopted thereafter by the following vote:
