HomeMy WebLinkAboutReso - CC - 119b-1989RESOLUTION NO. 119 B - 89 RESOLUTION APPROVING SPECIAL PERMIT AMENDMENT AND PARKING VARIANCE RESOLVED by the CITY COUNCIL of the City of Burlingame that: WHEREAS, application has been made for a special permit amendment and parking variance for a retail auto repair and restoration service at 50-60 Star Way (APN 026-131-190 1 and WHEREAS, the Planning Commission held a public hearing on said application on October 23 1989 at which time said application was approved; WHEREAS, this matter was _called up by City Council and a hearing thereon held on November 20 1 1989 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this /amendment and parkin�yariance Council that said special permit are approve , su Sect to the conditions set forth in Exhibit "A" attached hereto. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. I, JUDITH A. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 20th day of November 1989 and adopted thereafter by the following vote: AYES: COUNCILMEN: BARTON, HARRISON, LEMBI, O-MAHONY, PAGLIARO NOES: COUNCILMEN: NONE ABSENT: COUNCILMEN: NONE CP4Cc �vriC_ City Clerk EXHIBIT "A" Conditions of approval, special permit amendment and parking variance, 50-60 Star Way (effective November 21, 1989) Property owners: Nicholas & Stella Crisafi, 808 Burlway Rd. #200, Burlingame, CA 94010 1. that all conditions of the use permit granted on January 18, 1989 to 50-60-70 Star Way shall apply only to the operation of the business at 50-60 Star Way except that: a. all vehicles, operative or inoperative, on the premise for repair or maintenance or any other purposes associated with the business at 50-60 Star Way shall be parked and/or stored inside the portion of the structure identified as 50-60 Star Way and not left in required parking or any other area on the site outside of the structure; b. that the business shall be operated at all times in a manner consistent with the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame; C. that five of the six parking stalls on the site dedicated to this business at 50-60 Star Way shall be designated for employee parking and shall be used by employees; d. that no portion of the building designated as 50 or 60 Star Way shall be subleased to another business or activity without amendment to this use permit; e. storage of vehicles for this business shall be allowed on the adjacent paved railroad right-of-way so long as the property owner retains a legal lease to use this area and loss of this lease shall result in the review of this use permit; and f. that the use permit for 50-60 Star Way shall be reviewed by the City Council in six months (June 4, 1990) for compliance with the conditions and every two years thereafter or upon complaint, and any changes to the operation as outlined in the January 18, 1989 use permit as amended by the November, 1989 use permit shall require amendment to the use permit.
