HomeMy WebLinkAboutReso - CC - 105-1989RESOLUTION NO. 105-89 RESOLUTION DENYING HILLSIDE AREA CONSTRUCTION PERMIT 2990 DOLORES WAY RESOLVED, by the City Council of the City of Burlingame that: WHEREAS, application was made to the Planning Commission of the City of Burlingame by Ignatius Tsang on behalf of Si Ching Chan for a hillside area construction for 2990 Dolores Way; and WHEREAS, said application was heard by the Planning Commission of the City of Burlingame on August 28, 1989, said hearing being properly noticed as required by law; and WHEREAS, the permit was denied by the Planning Commission, a timely appeal filed by the applicants, and a public hearing upon said appeal scheduled and held by the City Council on September 18, 1989: NOW, THEREFORE, IT IS ORDERED AND DETERMINED by the City Council of the City of Burlingame: 1. That the following findings of fact are made regarding said application: (a) The application of Ignatius Tsang on behalf of Si Ching Chan is for the construction of a new 5,003 square foot two story home at 2990 Dolores Way (A.P.N. 025-302- 220), as more fully described on the plans submitted to the Planning Department and date stamped June 14, 1989. (b) The granting of the permit applied for will not be in the interests of the health and welfare of the persons in the vicinity of said property or of the City of Burlingame, and would not be in conformity with reasonable and orderly use of the property because: (1) Construction of the new house as proposed will cause the loss and reduction of existing distant views from neighboring properties, from 2999 Frontera Way and 2980 Dolores Way. (2) The proposed house as designed and placed upon the property impinges upon the views of neighbors, and could be reasonably designed and placed upon the property so as to cause less obstruction of existing distant views from neighboring properties. 3. The decision of the Planning Commission ,is hereby upheld and the hillside area construction permit for 2990 Dolores Way is denied. 4. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. MAYOR I, JUDITH A.
