HomeMy WebLinkAboutReso - CC - 104-1989RESOLUTION NO. in4-89 OPPOSITION TO THE IMPOSITION OF A GROSS RECEIPTS TAX BY THE SAN FRANCISCO AIRPORTS COMMISSION WHEREAS, the San Francisco Airports Commission propose a 7.5% gross receipts tax of off -airport car rental companies; and WHEREAS, the San Francisco Airports Commission is attempting to tax businesses outside of its legal jurisdiction by taxing businesses operating in cities in the County of San Mateo; and WHEREAS, 15% of the revenue generated from this proposed tax would go to the general fund of the City and County of San Francisco, not for maintenance and operations of the Airport; and WHEREAS, there are serious questions as to the legality of the proposed tax under the provisions of the California Constitution, Article XIII A and Article XIII B and is currently an issue being considered by California Appellate Courts; and WHEREAS, off -airport car rental companies are already paying a fair and reasonable charge for access to the airport and usage of airport facilities. NOW, THEREFORE, BE IT RESOLVED that the City of Burlingame vigorously opposes the San Francisco Airports Commission's proposed 7.5% gross receipts tax on off -airport car rental companies. I, Judith A. Malfatti, City Clerk of the City of Burlingame, do hereby certify that the foregoing Resolution was introduced at a regular meeting of the City Council held on the 18th day of September, 1989, and was adopted thereafter by the following vote: AYES: COUNCILMEMBERS: AMSTRUP, BARTON, LEMBI, MANGINI, PAGLI NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE
