HomeMy WebLinkAboutReso - CC - 103-1989RESOLUTION NO.103-89 RESOLUTION DENYING HILLSIDE AREA CONSTRUCTION PERMIT 2800 MARIPOSA RESOLVED, by the City Council of the City of Burlingame that: WHEREAS, application was made to the Planning Commission of the City of Burlingame by Vasilios Sianis for a hillside area construction for 2800 Mariposa Drive; and WHEREAS, said application was heard by the Planning Commission of the City of Burlingame on August 14, 1989, said hearing being properly noticed as required by law; and WHEREAS, the permit was denied by the Planning Commission, a timely appeal filed by the applicants, and a public hearing upon said appeal scheduled and held by the City Council on September 6, 1989: NOW, THEREFORE, IT IS ORDERED AND DETERMINED by the City Council of the City of Burlingame: 1. That the following findings of fact are made regarding said application: (a) The application of Vasilios Sianis is for the addition of a 1287 square foot second story, with a ridge line at elevation 135.75 feet, to his residence at 2800 Mariposa Drive (A.P.N. 025-072-010), as more fully described on the plans submitted to the Planning Department and date stamped July 25, 1989, and sheets 5,6, and 9 of the plans date stamped April 27, 1989. (b) The granting of the permit applied for will not be in the interests of the health and welfare of the persons in the vicinity of said property or of the City of Burlingame, and would not be in conformity with reasonable and orderly use of the property because: (1) Construction of the proposed second story will cause the loss and reduction of existing distant views from neighboring properties, particularly of areas of the City of Burlingame and particularly from the properties at 2805 and 2809 Las Piedras Drive. (2) The proposed second story addition is of unreasonable bulk; a less bulky second story addition with additional square footage on the first floor of the house is possible and reasonable and would result.is less obstruction of existing distant views. 3. The decision of the Planning Commission is hereby upheld and the hillside area construction permit for 2800 Mariposa Drive is denied. 4. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo, n _ /\ 10 I, JUDITH A.
