RESOLUTION DENYING VARIANCES. SPECIAL USE PERMIT
AND CONDOMINIUM PERMIT - 51 EL CAMINO REAL
RESOLVED, by the City Council of the City of
Burlingame that:
WHEREAS, application was made to the Planning
Commission of the City of Burlingame by David Sierra for
side setback and parking variances, a special permit for
height and a condominium permit for 51 E1 Camino Real, and
WHEREAS, said application was heard by the
Planning Commission of the City of Burlingame on Monday,
July 9, 1990, said hearing being noticed as required by law;
and
WHEREAS, the application was denied by the
Planning Commission, a timely appeal filed by the
applicants, and a public hearing upon said appeal scheduled
and held by the City Council on August 20, 1990:
NOW, THEREFORE, IT IS ORDERED AND DETERMINED by
the City Council of the City of Burlingame:
1. That the following findings of fact are made
regarding said application:
(a) The application of David Sierra is for a side
setback variance, a parking variance, a special permit for
height, and a condominium permit at 51 El Camino Real;
(b) Based on the application, the staff report, other
documents and the testimony at the hearing, the subject
project, variances and permits are not appropriate or
compatible with the uses of the subject property or
properties in the vicinity for the following reasons:
(1) the number of compact spaces proposed would
not leave enough spaces for standard sized vehicles; the
parking pattern in several spaces, while technically meeting
code requirements, is not workable.
(2) the height and bulk of the building is
excessive for the location, and would have a severe impact
upon the less densely occupied and zoned properties located
on Carol Avenue
2. The granting of the permit applied for would not
be in the interests of the health and welfare of the persons
using said property or in the vicinity of the property, and
would not be in conformity with reasonable and orderly use
of the property.
3. The decision of the Planning Commission is hereby
affirmed and said variances, special permit and condominium
permit are denied.

I, JUDITH A. MALFATTI, City Clerk of the City of
Burlingame, do hereby certify that the foregoing resolution
was introduced at a regular meeting of the City Council held
on the 5th day of September 1990, and was
adopted thereafter by the following vote:

NOES: COUNCILMEMBERS
