RESOLUTION APPROVING NEGATIVE DECLARATION AND
GRANTING SPECIAL USE PERMIT FOR REAL ESTATE OFFICE -
1412-1416 CHAPIN AVENUE
RESOLVED, by the City Council of the City of
Burlingame that:
WHEREAS, application was made to the Planning
Commission of the City of Burlingame by Fox and Carskadon
for a special use permit for a real estate office use at
1412-1416 Chapin Avenue; and
WHEREAS, said application was heard by the
Planning Commission of the City of Burlingame on
April 23, 1990, said hearing being properly noticed as
required by law; and
WHEREAS, the negative declaration was recommended
and the permit was approved by the Planning Commission, a
timely appeal filed, and a public hearing upon said appeal
scheduled and held by the City Council on May 21, 1990:
NOW, THEREFORE, IT IS ORDERED AND DETERMINED by
the City Council of the City of Burlingame:
1. on the basis of the Initial Study, the documents
submitted and reviewed, and comments received and addressed
by the Planning Commission and this Council, it is hereby
found that there is no substantial evidence that the project
set forth above will have a significant effect on the
environment, and Negative Declaration ND -437-P is hereby
approved.
2. That the following findings of fact are made
regarding said application:
(a) The application of Fox and Carskadon is for a real
estate office use on the ground floor of 1412-1416 Chapin
Avenue, as more fully set forth in said application;
(b) The use as described in the staff reports and
studies pertaining to the application and in the testimony
at the hearing is appropriate and compatible with the Zoning
District, and with the uses of the properties in the
vicinity of the premises. Its particular location enhances
Chapin Avenue; the site provides adequate parking
for this applicant's operation; the second floor will not be
used for this business and will be subject to later permits
if necessary.
3. The granting of the permit applied for will be in
the interests of the health and welfare of the persons using
said property, of the City of Burlingame, and, subject to
the conditions hereinafter set forth, will be in conformity
with reasonable and orderly use of the property.
4. The decision of the Planning Commission is hereby
affirmed and a special permit for real estate office use at
1412-1416 Chapin Avenue is approved, subject to the
conditions set forth in Exhibit "A" attached hereto.
5. It is further directed that a certified copy of
this resolution be recorded in the official records of the
County of San Mateo.

Burlingame, do hereby certify that the foregoing resolution
was introduced at a regular meeting of the City Council held
on the 4th day of June 1990,
and was adopted thereafter by the following vote:

NOES: COUNCILMEMBERS: NONE

Exhibit "A"
1. that the 4,490 SF first floor of the structure shall be used for
a real estate office which has a maximum of three full time and
33 part time agents;
2. that a group agents meeting shall be held only once a week and
shall be over by 11:00 A.M. with a maximum attendance of 30
agents;
3. that the real estate use shall not extend to the second floor of
that building without amendment to this use permit nor shall the
number of full time and part time agents or duration and
frequency of the weekly group meetings change without amendment

to this use permit;
4. that this use permit shall be reviewed for compliance with these
conditions in 18 months time and every two years thereafter or
upon complaint; and
5. that a lot combination map shall be filed and approved prior to
issuing a foundation or building permit -for this property.

This is to confirm our intention to relocate our existing business at 406 Primrose Road in
Burlingame to a new construction facility on Chapin Avenue. As previously stated, we
hereby agree to the following:
a. To sub -lease the Primrose facility to a party other than a real estate
broker, financial institution or restaurant.
b. To sub -lease the Primrose facility for terms not to exceed one year
each.
C. To return the premises to the Library Trust upon their request at the
end of the sub -lease agreement term then in effect.
