HomeMy WebLinkAboutReso - CC - 065-1990RESOLUTION N0, 65-90 RESOLUTION APPROVING NEGATIVE DECLARATION AND GRANTING CONDOMINIUM PERMITS - 1499 OAK GROVE AVENUE RESOLVED, by the City Council of the City of Burlingame that: WHEREAS, application was made to the Planning Commission of the City of Burlingame for a condominium permit at 1499 Oak Grove Avenue; and WHEREAS, said application was heard by the Planning Commission of the City of Burlingame on May 14, 1990, said hearing being properly noticed as required by law; and WHEREAS, the negative declaration was recommended and the condominium permit was approved by the Planning Commission, a timely appeal filed, and a public hearing upon said appeal was scheduled and held by the City Council on June 4, 1990: NOW, THEREFORE, IT IS ORDERED AND DETERMINED by the City Council of the City of Burlingame: 1. On the basis of the Initial Study, the documents submitted and reviewed, and comments received and addressed by the Planning Commission and this Council, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Negative Declaration ND -438-P is hereby approved. 2. That the following findings of fact are made regarding said application: (a) The application is for a 16 unit condominium at 1499 Oak Grove Avenue, as more fully set forth in said application; (b) The condominium as described in the staff reports and studies pertaining to the application and in the testimony at the hearing meets the condominium standards of the Burlingame Municipal Code. 3. The granting of the condominium permit will be in the interests of the health and welfare of the persons using said property, of the City of Burlingame, and, subject to the conditions hereinafter set forth, will be in conformity with reasonable and orderly use of the property. 4. The decision of the Planning Commission is hereby affirmed and the condominium special permit 1499 Oak Grove is approved, subject to the conditions set forth in Exhibit "A" attached hereto. 5. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. MAYOR , I, JUDITH A. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 4th day of June ,1990, and was adopted thereafter by the following vote: AYES: COUNCILMEMBERS: BARTON, LEMBI, O'MAHONY, PAGLIARO NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: HA SON / CITY CLERK EXHIBIT "A" Conditions of approval, residential condominium permit, 1495, 1497 and 1499 Oak Grove Avenue (APN 029-100- 010/020/030) (effective June 5, 1990) Property owner: Kanno & Kanno, Inc. 251 Post Street, Suite 610 San Francisco, CA 94108 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped March 23, 1990 and amended May 3, 1990; 2. that the project shall meet Uniform Building and Fire Codes as amended by the City of Burlingame; 3. that the conditions of the City Engineer's memo of May 2, 1990, the Fire Marshal's memo of April 4, 1990 and the Chief Building Inspector's memo of April 6, 1990 shall be met; 4. that a security system with an intercom to each unit shall be provided for access to the designated guest parking in the garage; 5. that three guest parking stalls shall be designated and marked on the plans and tentative map and not assigned to a unit but shall be owned and maintained by the condominium association; 6. that final inspection shall be completed and a certificate of occupancy issued before the close of escrow on the sale of each unit; 7. that the developer shall provide the initial purchaser of a unit and the board of directors of the condominium association an owner -purchaser manual which shall contain the name and address of all contractors who performed work on the project, copies of all warranties or guarantees of appliances and fixtures and the estimated life expectancy of all depreciable component parts of the property, including but not limited to the roof, painting, common area carpets, drapes and furniture; 8. that the project shall include the placement of four 24" box trees on the site and the species and location shall be approved by the Parks Department as a part of the landscape and irrigation review prior to issuing a building permit; -2- 9. that the driveway shall be redesigned to provide a 151 pad with a maximum slope of 58 on the portion of the driveway immediately adjacent to the sidewalk in order to increase the driver's view of pedestrians and cars in the adjacent travel lanes; 10. that the security gate for the garage shall be relocated in order to allow the three required guest parking stalls to be located in front of the gate; 11. that a warning light shall be placed at the top of the driveway to warn pedestrians that cars will be exiting from the below grade garage and guest parking; 12. that a "right turn only" sign shall be placed on the site at the end of the driveway requiring exiting cars to turn right only, the sign shall be maintained by the homeowners association; and 13. that during construction hauling of soils shall not be done during the hours students are being dropped off and picked up at school, e.g., between 8:00 and 9:00 A.M. and 1:45 to 3:00 P.M.
