RESOLUTION GRANTING VARIANCES
910 Howard Avenue
RESOLVED, by the City Council of the City of
Burlingame that:
WHEREAS, application was made to the Planning
Commission of the City of Burlingame by Kenneth Morando and
Ronald Mafrici for four variances to allow the construction
of a three unit apartment building at 910 Howard Avenue; and
WHEREAS, said application was heard by the
Planning Commission of the City of Burlingame on May 14,
1990, said hearing being properly noticed as required by
law; and
WHEREAS, the permit was denied by the Planning
Commission, a timely appeal filed by the applicants, and a
public hearing upon said appeal scheduled and held by the
City Council on June 4, 1990:
NOW, THEREFORE, IT IS ORDERED AND DETERMINED by
the City Council of the City of Burlingame:
1. That the following findings of fact are made
regarding said application:
(a) The application of Kenneth Morando and Ronald
Mafrici is for four variances to allow the construction of a
three unit apartment building at 910 Howard Avenue.
(b) The exceptional and extraordinary circumstances
and conditions applicable to the property involved that do
not apply generally to other properties in the district are
that the subject lot is quite narrow, the property uses in the immediate
area are mixed and varied, and this proposal provides appropriate infill;
and the granting of the variances is therefore necessary
for the preservation and enjoyment of a substantial property
right and to prevent unreasonable hardship.
2. The granting of the variances applied for will be
in the interests of the health and welfare of the persons
using said property, of the City of Burlingame, and, subject
to the conditions hereinafter set forth, will be in
conformity with reasonable and orderly use of the property.
3. The decision of the Planning Commission is hereby
reversed and the four variances to allow the construction of
a three unit apartment building at 910 Howard Avenue are
approved, subject to the conditions set forth in Exhibit "A"
attached hereto.
4. It is further directed that a certified copy of
this resolution be recorded in the official records of the
County of San Mateo.
I, JUDITH A. MALFATTI, City Clerk of the City of
Burlingame, do hereby certify that the foregoing resolution
was introduced at a regular meeting of the City Council held
on the 4th day of June 1990, and was
adopted thereafter by the following vote:

1. that the structure shall be built according to the plans
submitted to the Planning Department and date stamped April 23,
1990;
2. that the covered parking area shall be fire sprinklered with a
system off the domestic water supply serving the residential
portion of the structure; and
3. that all requirements of the Uniform Building and Uniform Fire
Codes shall be met.
