HomeMy WebLinkAboutReso - CC - 032-1989RESOLUTION NO. -S RESOLUTION APPROVING NEGATIVE DECLARATION RESOLVED by the City Council of the City of Burlingame, California that: WHEREAS, a Negative Declaration has been proposed for church use at 1157 California Drive and WHEREAS, it is the intention of this Council to approve said Negative Declaration as set forth hereinafter; NOW, THEREFORE, it is FOUND, ORDERED and DETERMINED that: On the basis of the Initial Study and any comments received by the City Council it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Negative Declaration ND -421P is hereby approved. "URL VIGAr iE NEGATIVE DECLARATION ND 421-P 1157 CALIFORNIA DRIVE - PROPOSED USE OF SITE FOR CHURCH SERVICES This project is for conducting church services and other religious activities in an existing building originally built and used as a movie theater. The proposal does not include any alterations to the building other than cleaning and painting it. However, some interior remodelling of the building will be required in order to meet building and fire code requirements. The proposed use of the site would involve having church services twice a day on Saturdays and Sundays at 10 AM and 6 PM for a maximum of 54 people per mass. During the week the site would be used for other religious activities such as prayer meetings, fellowship meetings, religious counseling and community service work meetings. These activities would take place at 7PM for a maximum of 10 people. The church will have 54 fixed seats in the assembly area. Based on this number of fixed seats, 9 parking spaces are required for this use. In addition there are two retail/service uses on the ground floor of the building which bring the total required parking for the site to 12 spaces. There are 12 parking spaces on the property, therefore this project meets the parking requirements established by the zoning ordinance. The proposed church use will be completely contained inside the building, therefore the appearance of the site will not be affected. The area in general is developed with a variety of retail and service uses, and the proposed church use is small enough that it should not affect the character of the area. The building will be required to meet building code and fire code requirements, therefore there should not be any negative effects on public health and safety. The proposed use of the site would involve a maximum of 54 people coming to the site twice a day (10 AM and 6 PM) on weekends and up to 10 people using the site on weekdays at 7:00 PM. Since the weekday use of the property would be for only 10 people and would take place at 7 PM when at least one of the retail tenants would have closed, there should be enough parking on the property to accomodate the use. Although the proposed use meets the parking requirements established by the code, there may be a need to use some street parking during the weekend church services. However, on weekends there is generally more street parking available in the area than on weekdays, therefore this increased use of the property on weekends should not create any significant traffic or parking impacts in the area. Also, since church services will be offered at 10 AM and 6 PM, they are spaced far enough apart that there should not be an overlap of people coming to the site and those preparing to leave the site. INITIAL STUDY: The Initial Study determined that the project, as proposed, will not cause any of the following effects: IVO I.
