RESOLUTION APPROVING NEGATIVE DECLARATION -
REZONING AND GENERAL PLAN AMENDMENT OF CERTAIN LANDS
BOUNDED BY BROADWAY, ROLLINS ROAD,
TOYON DRIVE. AND CAROLAN AVENUE
RESOLVED by the City Council of the City of
Burlingame, California that:
WHEREAS, a Negative Declaration has been proposed
regarding the rezoning and general plan amendment of certain
lands bounded by Broadway, Rollins Road, Toyon Drive, and
Carolan Avenue from the M-1 and R-4 Zoning Districts to the
C-1 and C-2 Zoning Districts; and
WHEREAS, it is the intention of this Council to
approve said Negative Declaration as set forth hereinafter:
NOW,THEREFORE, it is FOUND, ORDERED AND DETERMINED
that:
On the basis of the Initial Study, the documents
submitted and reviewed, and comments received and addressed
by the Planning Commission and this Council, it is hereby
found that there is no substantial evidence that the project
set forth above will have a significant effect on the
environment, and Negative Declaration ND -435-P is hereby
approved. , // n

The City of Burlingame by MARGARET MONROE on
MARCH 21 , 1990, completed a review of the
proposed project and determined that:
(X) It will not have a significant effect on the environment
(X) No Environmental Impact Report is required.
Reasons for Conclusion:
Since the proposed changes will encourage and support
continuation of the present land uses and there is no vacant or
underused land to be developed, the project to align the general
plan and city policy with existing uses will not result in any
new or change in environmental impacts. Since the existing uses
will become permitted uses the city will have better control over
future modifications to structures and the conforming uses within
them.

PROJECT DESCRIPTION:
The proposed project is to amend the general plan land use designation and adjust the zoning
in order to better reflect the present use of the properties .located within the area bounded
by Broadway (west), Rollins Road (north), Toyon Drive (east) and Carolan Avenue (south).
The proposal is to change the general plan land use designations so that they better reflect
the actual use and zoning. In a few cases it will be necessary to change the zoning to
match the land use. Specifically the properties fronting on Toyon would be changed from
service and special sales commercial to low density residential conforming to their present
R-1 and R-3 zoning designations and uses. The property behind this to the west (auto
dealerships) would retain its service and special sales general plan designation but would
be rezoned from M-1 light industrial to C-2 heavy commercial, the appropriate zone for
auto sales and service. C-2 is also the zone used in the general plan to implement the
service and special sales land use designation.
The area west of the auto dealerships fronting on Carolan Avenue to Cadillac Way, a large
campus type apartment complex, would have its general plan designation changed from service
and special sales to high density residential to be consistent with its present R-4
residential zoning. On the north side of the apartment complex are three properties now
developed in commercial uses (office building, gas station, restaurant and parking
structure) with a general plan land use designation of`service and special sales, but zoning
of R-4 and M-1. These three parcels would be rezoned to C-2. Across Cadillac Way, between
Cadillac-Carolan-Broadway and Rollins Road, is an area occupied by auto dealerships and
designated on the land use map as service and special sales. This area would be rezoned
from M-1 light industrial to C-2 heavy commercial, the appropriate implementing zoning
for the general plan designation and also appropriate for the auto sales/service use.
The area is fully developed. The proposed project would not change any existing land
uses.
ENVIRONMENTAL SETTING:
The project area is a basically flat area which has been fully developed since the mid -1950's.
The residential areas are landscaped with typical exotic plants. There are no rare or
endangered plant or animal species present in the area. All city services and utilities
are provided in this area and have adequate capacity for the development. The area is in
the flatlands but is not a designated flood hazard zone.

DETERMINATION:
On the basis of this initial evaluation:
