INC - 1280 ROLLINS ROAD RESOLVED, by the City Council of the City of Burlingame WHEREAS, application was made to the Planning Commission of the City of Burlingame by Byrgan, Inc. for a special permit for an embalming and refrigerated holding facility at 1280 Rollins Road; and WHEREAS, said application was heard by the Planning Commission of the City of Burlingame on Monday, April 27, 1992, said hearing being noticed as required'by.lavr; and WHEREAS, the permit was approved by the Planning Commission, called up for review by the City Council, and public to hearings scheduled and held by the City Council on May 18, 1992, W and October 5, 1992: V NOW, THEREFORE, IT IS ORDERED AND DETERMINED by the City Council of the City of Burlingame that said special permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. It ,is further ordered that a certified copy of this resolution shall be recorded ii of San Mateo. Zounty I, JUDITH A. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 5th day of October 1992, and was adopted thereafter by the following vote: AYES: COUNCILMEMBERS: HARRISON, KNIGHT, O'MAHONY, PAGLIARO NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: I hall" o"Rily this to b a failo t" and oor"M MM o! tM Ooomw"t it Purports to oo, tis wig"" of V" N► on fila in 9W 4WIM& F=T EXHIBIT "A" Conditions of approval, special permit, 1280 Rollins Road (effective October 6, 1992) 1. that the applicant shall use and make improvements to the building as shown on the plans submitted to the Planning Department and date stamped March 12, 1992; that the applicant shall prepare and submit to the city for approval a plan for the storage and use of all toxic materials to be used on the site and for disposal of all embalming and human wastes and that the use of this site shall not comm_nce until this plan has been found to be complete and can be approved by the appropriate city staff and other regulatory agencies, and the required improvements and procedures fully implemented, certified and executed, and the applicant shall obtain an OSHA walk -around inspection and make all required corrections before commencing the permitted business at this site and shall present documentation to the City Planning Department of such inspection and his compliance with any required corrections; 3. that the only access for this use to'this,_$ite shall be via Nerli Lane and the access easement unless proper curb cuts are installed, paved driveway provided and parking to code dimensions is relocated and approved by the Planning Department or, if a variance is required, approved by the Planning Commission, and it is the responsibility of the tenant to ensure that the access across the easement at 1304-1316 Marsten Road is available 24 hours a day seven days a week; 4. that all the requirements of the Uniform Building Code and Uniform Fire Code shall be met, inspected and approved for all improvements and installations on the site before the site shall be occupied by this use; 5. that this use permit shall be reviewed for compliance with the conditions in six months (April, 1993) and each year thereafter, upon complaint, upon any violation of any waste disposal or sewer discharge requirements, or upon failure to schedule or pass any inspection,by any one of the agencies with regulatory authority over this type of business; 6. that all existing signs from other businesses on this site shall be removed within 30 days; 7. that none of the vehicles associated with this business except that used by the president of the company shall be parked overnight at 2020 Easton Drive; and 8. that no memorial services shall be held at this site.
