HomeMy WebLinkAboutReso - CC - 033b-1990RESOLUTION NO. 33B -90 RESOLUTION APPROVING VARIANCES AND SPECIAL PERMITS RESOLVED by the CITY COUNCIL of the City of Burlingame that: WHEREAS, application has been made for two variances and three special permits to allow use of an accessory structure for living purposes at_ 919 Capuchino Avenue (APN 026-223-060), and WHEREAS, the Planning Commission held a public hearing on said application on Januar 22 ,_ 1990 at which time said application was denied; WHEREAS, this matter was appealed to Council and a hearing thereon held on March 19 1990 at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that said variances and special permits are approved, subject to the conditions set forth in Exhibit "A" attached hereto. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. I, JUDITH A. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 19th day of March 1990 and adopted thereafter by the following vote: AYES: COUNCILMEN: BARTON, HARRISON, LEMBI, O-MAHONY NOES: COUNCILMEN: PAGLIARO ABSENT: COUNCILMEN: NONE r City Clerk EXHIBIT "A" Conditions of approval, two variances and three special permits for an accessory structure, 919 Capuchino Avenue (effective March 20, 1990) Property owners: Kerry R. & Richard A. Harlick 919 Capuchino Avenue, Burlingame, CA 94010 1. that the project shall meet all Uniform Building and Fire Code requirements as amended by the City of Burlingame; 2. that all plumbing fixtures to the previous kitchen and the existing shower shall be removed and stubbed off; 3. that a toilet and sink shall be left; 4. that the accessory structure shall not be used as a separate dwelling unit unless all required parking is provided on site; 5. that the stairwell shall be relocated out of the driveway area; 6. that this permit shall be reviewed for compliance with these conditions in six months (September, 1990); and 7. that the use permit shall expire in 10 years (March, 2000) or upon sale of the property by the present owner, Richard A. Harlick, and that the accessory structure shall only be occupied by a member of the immediate family.
