HomeMy WebLinkAboutReso - CC - 031-1990RESOLUTION NO. 31-90 RESOLUTION APPROVING VARIANCE RESOLVED by the CITY COUNCIL of the City of Burlingame that: WHEREAS, application has been made for a variance for parking to convert a second floor to retail commercial use at 311 Primrose Road (APN 029-122-170 and WHEREAS, the Planning Commission held a public hearing on said application on January 22 1990 , at which time said application was approved; WHEREAS, this matter was called up by Council and a hearing thereon held on February 21 , 1990 at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that said variance is approved, subject to the conditions set forth in Exhibit "A" attached hereto. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. Mayor I, JUDITH A. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 5th day of March , 1990 , and adopted thereafter by the following vote: AYES: COUNCILMEN: HARRISON, LEMBI, O'MAHONY NOES: COUNCILMEN: BARTON ABSENT: COUNCILMEN: PAGLIARO `d%?6� S) City Clerk EXHIBIT "A" 311 Primrose Road, Burlingame APN 029-122-170 1. that the project shall be built as proposed on the - plans submitted to the Planning Department date stamped December 5, 1990; 2. that the project shall meet all Uniform Building and Fire Code requirements as amended by the City of Burlingame; 3. that a second exit shall not be required as long as the occupant load is not 10 or greater as determined by the Fire Marshal; and 4. that the owner shall write a letter to the Fire Marshal stating an understanding of the occupant load for the second floor area and second exit requirements.
