RESOLUTION APPROVING CATEGORICAL EXEMPTION. VARIANCE
FOR FLOOR AREA RATIO AND VARIANCE FOR 43 PARKING SPACES
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and
application has been made for a variance for floor area ratio and a 43
space parking variance for the remodel and seismic retrofit of the
structure at 1420 Burlinaame Avenue (APN 029-122-090/2201.
and
WHEREAS, the Planning Commission held a public hearing on
said application on August 10 1992 at which time said
application was denied;
WHEREAS, this matter was annealed to City Council and a
hearing thereon held on September 9 1 1992 , at which time it
reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this
Council that:
1. On the basis of the Initial Study and the documents submitted
and reviewed, and comments received and addressed by this council, it
is hereby found that there is no substantial evidence that the project
set forth above will have a significant effect on the environment, and
a Categorical Exemption Section 15301 Class 1 (e) and (d) is hereby
approved;
2. Said variances are approved, subject to the conditions set
forth in Exhibit "A" attached hereto. Findings for such variances are
as set forth in the minutes and recording of said meeting.

do hereby certify that the foregoing resolution was introduced at a
regular meeting of the City Council held on the 9th day of
September, 1992 , and adopted thereafter by the following vote:

EXHIBIT "A"
Conditions of approval,
variances, 1420 Burlingame Avenue
(effective September 10, 1992)
1. that the project shall be built as shown on the plans submitted to
the Planning Department and date stamped May 6, 1992 with maximum
gross floor areas per floor of basement 7,700 GSF, first floor
7,700 GSF, mezzanine/ second floor 4,821 GSF, third floor 7,700
GSF, fourth floor 7,700 GSF;
2. that the uses by floor shall be basement storage related to the
uses in the building, not leased to a separate tenant; first floor
retail sales and service, except food establishments; second,
third and fourth floors office uses as permitted or conditioned by
the zoning, no health services;
3. that the separate lot at the rear shall be retained for parking,
shall provide 30 parking spaces available to the tenants of this
building and their customers/ clients and shall not be leased
separately for a fee to any other business, use or activity
including valet parking without amendment to this use permit;
4. that this structure shall include compliance with all the
requirements of the Uniform Building Code and Uniform Fire Code as
amended by the City of Burlingame and the requirements for seismic
upgrade; and
5. that eight spaces in the at -grade parking at the rear of the
building shall be marked "two hour parking for customer use only"
and this use shall be enforced by the property owner.
