HomeMy WebLinkAboutReso - CC - 069-1992RESOLUTION NO. 69-92 RESOLUTION CERTIFYING A NEGATIVE DECLARATION FOR THE JOINT SOURCE REDUCTION AND RECYCLING ELEMENT RESOLVED, by the CITY COUNCIL of the CITY OF BURLINGAME, State of california, that; WHEREAS, the California Waste Management Act of 1989 (Assembly Bill 939) amended by other State legislation (AB 1820, 1990, AB 888, 1989, and 2707, 1990) requires all cities and counties within the State to adopt a Source Reduction and Recycling Element; and WHEREAS, in San Mateo County the following 16 jurisdictions of Atherton, Belmont, Burlingame, Colma, Daly City, East Palo Alto, Foster City, Half Moon Bay, Hillsborough, Menlo Park, Portola Valley, Redwood City, San Carlos, San Mateo, Woodside, and the San Mateo County unincorporated area have joined together to prepare a Joint Source Reduction and Recycling Element; and WHEREAS, the Joint Source Reduction and Recycling Element will become a policy document when adopted by the 16 participating jurisdictions and incorporated into the San Mateo County Integrated Solid Waste Management Plan; and WHEREAS, the Board of Supervisors is authorized by Public Resources Code Sections 21067 and 21165 and State CEQA Guidelines Section 15050 to assume the status of lead agency; and WHEREAS, the County of San Mateo has assumed the role of lead agency for the Joint Source Reduction and Recycling Element; and WHEREAS, the county has performed an initial study and has determined that the proposed Joint Source Reduction and Recycling Element will have no significant environmental impacts and that a Negative Declaration is appropriate; and WHEREAS, each jurisdiction of San Mateo County in its capacity as a "responsible agency" has reviewed the environmental document under the "informal consultation" requirements of CEQA Guidelines Section 15063(g) and has concurred in the processing of a Negative Declaration for the Joint Source Reduction and Recycling Element; and WHEREAS, the County Planning Division has circulated the Negative Declaration to the State Clearinghouse and the "responsible agencies," for review for a 30 -day period from May 14, 1992 to June 12, 1992; and WHEREAS, the County has responded to all comments received during the comment period; and WHEREAS, on the basis of the Initial Study, comments received thereto, and testimony presented and considered at the public hearing, that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED AS FOLLOWS: a.) The City Council certifies that the Negative Declaration for the Joint Source Reduction and Recy- cling Element reflects the independent judgment of the City Council and is complete, correct, and adequate and prepared in accordance with all applicable State and local guidelines. b. ) That on the basis of the Initial Study, comments received thereto, and testimony presented and considered at the public hearing, there is no substantial evidence that th project will have significant effect on t nv,i moment.
