HomeMy WebLinkAboutReso - CC - 042-1991RESOLUTION NO. 42-91 RESOLUTION APPROVING SPECIAL PERMIT RESOLVED by the CITY COUNCIL of the City of Burlingame that: WHEREAS, application has been made for a special permit to convert 1,031 SF of warehouse to retail sales in Unit #1 at 1461 Bayshore Highway (APN 026-111-110), and WHEREAS, the Planning Commission held a public hearing on said application on March 25 1991 , at which time said application was denied; WHEREAS, this matter was appealed to City Council and a hearing thereon held on April 15 , 1991 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that said permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. MAYOR I, JUDITH A. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 15th day of April, 1991 and adopted thereafter by the following vote: AYES: COUNCILMEN: HARRISON, LEMBI, 0-MAHONY, PAGLIARO NOES: COUNCILMEN: BARTON ABSENT: COUNCILMEN: NONE ITY CLERK EXHIBIT "A" Conditions of approval, special permit, 1461 Bayshore Highway, Unit 1 (effective April 16, 1991) Property owners: Nicholas & Stella Crisafi, TRS 808 Burlway Road - #200 Burlingame, CA 94010 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped February 28, 1991 Sheets One and Two, and the maximum area for retail sales shall be 31' x 33'-4"; 2. that the conditions of the City Engineer's memo of March 11, 1991 shall be met; 3. that the use permit shall be amended if an oversized semi truck which would block parking stalls beyond number 13 as shown on the February 28, 1991 plans ever makes deliveries between the hours of 10:00 A.M. and 5:00 P.M. Monday through Saturday, and if the gate between Units 1 and 2 is ever used for through access from Unit 2; 4. that the retail sales shall occur Monday through Saturday 10:00 A.M. to 5:00 P.M. with no more than one full time employee engaged in the retail sales; 5. that the project shall meet Uniform Building and Fire Codes as amended by the City of Burlingame; and 6. that this use permit shall be reviewed in nine months time (January 15, 1992) or upon complaint.
