RESOLUTION APPROVING CATEGORICAL EXEMPTION
CONDOMINIUM PERMIT, FRONT AND REAR SETBACK VARIANCES
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
condominium permit and front and rear setback variances for a new three story. 4 unit condominium
at 1273 El Camino Real, APN: 026-151-040 ; property owner: John Sullivan279 Avalon Drive,
Daly City; and
WHEREAS, the Planning Commission held a public hearing on said application on October
11 , 1994 , at which time said application was approved;
WHEREAS, this matter was called up by City Council and a hearing thereon held on
November 7. 1994 , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this council, it is hereby found that there is no substantial
evidence that the project set forth above will have a significant effect on the environment, and
categorical exemption Section 15303 Class 3 (b) In urbanized areas, this exemption applies to single
apartments, duplexes and similar structures designed for not more than six dwelling units if
construction is in conjunction with the building . . . of two or more such structures is hereby
approved.
2. Said condominium permit and front and rear setback variances are approved subject to
the conditions set forth in Exhibit "A" attached hereto. Findings for such variances and condominium
permits are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

effective NOVEMBER 7, 1994
1. that the project shall be built as shown on the plans submitted to the Planning Department date
stamped September 16, 1994 Sheets Al, A2P, A3, A4, A5, and A6; Landscape plan sheet L-1 date
stamped September 19, 1994 and Tentative Parcel Map date stamped September 19, 1994;
2. that the conditions of memorandums written by the Associate Engineer (September 20, 1994), Fire
Marshal (July 26, 1994), Building Official (September 6, 1994) and Park Director (September 1,
1994) and the requirements of the CS 11.06, Urban Reforestation and Tree Protection, shall be met;
3. that a security system with an intercom to each unit shall be provided to allow access to the
designated guest/disabled parking stall and that the stall shall be marked as such;
4. that the guest/disabled parking stall shall be owned and maintained by the condominium association
and shall not be assigned to any unit unless requested by a unit owner to provide parking expressly
for an occupant with a disability, if this is the case, the condominium association shall inform the
Planning Department that there is no longer guest parking on the site;
5. that the final inspection shall be completed and a certificate of occupancy issued before the close of
escrow on the sale of each unit;
6. that the developer shall provide the initial purchaser of each unit and to the board of directors of the
condominium association, an owner purchaser manual which shall contain the name and address of
all contractors who performed work on the project, copies of all warranties or guarantees of
appliances and fixtures and the estimated life expectancy of all depreciable component parts of the
property, including but not limited to the roof, painting, common area carpets, drapes and furniture;
7. that two parking spaces shall be provided with the sale of each unit, solely for use by the
condominium owners and their guests, that no additional fee shall be charged for the parking spaces,
and that no portion of any parking area or aisle shall be converted to any other use or any support
activity such as storage or utilities;
8. that the project, including access and egress requirements, shall meet all the requirements of the
Municipal Code, Uniform Building Code and Uniform Fire Code as amended by the City of
Burlingame.
9. that no action on the variances or residential condominium permits shall become effective until the
applicant has received a tree removal permit for the 2' diameter eucalyptus and 16" diameter silk oak
trees and the site landscape plans showing required placement trees and conformance with the tree
Preservation and Reforestation Ordinance have been approved by the Director of Parks; and
10. that the decks be angled in such a manner that they do not extend into the easement.
