RESOLUTION NO. 44-92
APPROVING ABAG PROPERTY INSURANCE PROGRAM AND
AMENDMENT OF ABAG PLAN AGREEMENT

5 WHEREAS, the CITY OF BURLINGAME is empowered under
6 Government Code Section 989 _Pt sec., and Labor Code Section 3700
7 to insure itself against liability and other losses, workers'
8 compensation claims and to provide insurance and self-insurance
9 in any desired combination; and
10 WHEREAS, the CITY OF BURLINGAME is a member of the
11 Association of Bay Area Governments (ABAG); and
12 WHEREAS, the CITY OF BURLINGAME desires to contract with
13 ABAG and other members of ABAG to pool their self-insured
14 losses; jointly purchase excess insurance; and to develop
15 effective risk management and loss control programs to reduce
16 the amount and frequency of its losses (hereafter referred to as
17 the "PLAN Program"); and
18 WHEREAS, the Revised Risk Coverage Agreement dated as of
19 July 1, 1992 is on file with the City Attorney and is available
20 for review by members of the City Council and members of the
21 general public; and
22 WHEREAS, the Revised Risk Coverage Agreement provides for
23 the continuation of the PLAN Program in a more flexible form
24 with a wider range of insurance coverages; and
25 WHEREAS, the Board of Directors of the ABAG PLAN
26 lCorporation representing participating cities/towns in the PLAN

rogram have recommended approval of the Revised Risk Coverage
greement; and
WHEREAS, it has been recommended that the CITY OF
URLINGAME participate in the ABAG Plan Property Insurance
Program, effective July 1, 1992;
NOW, THEREFORE BE IT RESOLVED, that the City Manager is
ereby authorized and directed to execute and deliver the
Revised Risk Coverage Agreement in substantially the form on
file with the City Attorney to the Association of Bay Area
overnments and to execute and deliver such documents as may be
reasonably necessary to effectuate the Revised Risk Coverage
greement and participation in the Property Insurance Program.
