HomeMy WebLinkAboutReso - CC - 014-1991RESOLUTION NO, 14-91 RESOLUTION DENYING HILLSIDE AREA CONSTRUCTION and CREEK ENCLOSURE PERMIT 2652 SUMMIT DRIVE RESOLVED, by the City Council of the City of Burlingame that: WHEREAS, application was made to the Planning Commission of the City of Burlingame by John Lee on behalf of Tung Ling for a hillside area construction permit and a creek enclosure permit for 2652 Summit Drive; and WHEREAS, said application was heard by the Planning Commission of the City of Burlingame on December 10, 1990, said hearing being properly noticed as required by law; and WHEREAS, the permit was approved by the Planning Commission, a timely appeal filed, and a public hearing upon said appeal scheduled and held by the City Council on January 23, 1991: NOW, THEREFORE, IT IS ORDERED AND DETERMINED by the City Council of the City of Burlingame: 1. That the following findings of fact are made regarding said application: (a) The application of John Lee on behalf of Tung Ling is for the construction of a new 12,228 square foot two story home at 2652 Summit Drive (A.P.N. 027-271-310), as more fully described on the plans submitted to the Planning Department and date stamped October 19, 1990 and November 9, 1990; and (b) The granting of the permit applied for will not be in the interests of the health and welfare of the persons in the vicinity of said property or of the City of Burlingame, and would not be in conformity with reasonable and orderly use of the property because: (1) Construction of the new house as proposed will cause the loss and reduction of existing distant views from neighboring properties, including 2614 through 2628 Summit Drive; (2) The proposed house as designed and placed upon the property impinges upon the views of neighbors, and could be reasonably designed and placed upon the property so as to cause less obstruction of existing distant views from said neighboring properties. 3. The decision of the Planning Commission is hereby reversed and the hillside area construction permit and creek enclosure permit for 2652 Summit Drive is denied. 4. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. MAYOR I, JUDITH A.
