RESOLUTION APPROVING VARIANCE
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, application has been made for a variance to side
yard setback for an existing carport
at 120 Bancroft Road (APN 029-284-210) and
WHEREAS, the Planning Commission held a public hearing on
said application on October 9 , 1990 at which
time said application was approved;
WHEREAS, this matter was aooealed to City Council and
hearings thereon held on November 5. 1990 and January 7 1991
at which time it reviewed and considered the staff report and all
other written materials and testimony presented at said hearings;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this
Council that said variance is approved, subject to the conditions
set forth in Exhibit "A" attached hereto.
It is further directed that a certified copy of this
resolution be recorded in the official records of the County of San
Mateo.

do hereby certify that the foregoing resolution was introduced at a
regular meeting of the City Council held on the 7th day of
January r 1991 , and adopted thereafter by the following
vote:

EXHIBIT "A"
Conditions of approval, side yard
setback variance, 120 Bancroft Road
(effective January 8, 1991)
1. that the carport shall be located on the site as shown on the site
plan submitted to the Planning Department and date stamped August
20, 1990 with a 1' side setback from property line;
2. that the wall of the carport closest to property line shall be of
one hour construction as defined by the Uniform Building Code and
approved by the Building Department and that the entire structure
shall meet the requirements of the Uniform Building and Uniform
Fire Codes;
3. that the minimum clearance between the surface of the driveway and
the closest horizontal portion of the carport shall be.7'-0";
4. that a penalty fee shall be charged for the building permit; and
5. that this permit shall be reviewed for compliance in six months
(June, 1991) and should, in the future, the carport be damaged
beyond normal maintenance and repair or removed it shall not be
replaced and this variance shall expire; in addition this permit
shall be reviewed in five years.
