RESOLUTION 283-95
RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND SPECIAL PERMIT
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
special permit to allow a canning operation and outdoor storage at 1333 Marsten Road. APN: 026-
133=010 ; property owner• Steve Reece 1104 San Mateo Avenue San Francisco. CA ; and
WHEREAS, the Planning Commission held a public hearing on said application on October 10.
1995 , at which time said application was approved;
WHEREAS, this matter was appealed to City Council and a hearing thereon held on November
66. 1995 , at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that mere is no substantial evidence that
the project set forth above will have a significant effect on the environment, and categorical exemption
Article 19. Section: 15301 - Existing Facilities, Class 1(d), Restoration or rehabilitation of deteriorated

or damaged structures, facilities, or mechanical equipment to meet current standards of public health and

safety is hereby approved.

2. Said special permit is approved subject to the conditions set forth in Exhibit "A" attached

hereto. Findings for such Special Permit are as set forth in the minutes and recording of said meeting.

3. It is further directed that a certified copy of this resolution be recorded in the official
recprds of the County of San Mateo.

Conditions of approval categorical exemption and special permit
1333 MARSTEN ROAD
effective NOVEMBER 6, 1995
1. that the uses shall occupy square footage within the building, as shown
on the Plans date stamped August 23, 1995, Sheet 1 and Sheet 2, with
a maximum of 14 employees, owners and affiliates on site in your
business;
2. that 14 parking spaces, as shown on the amended plan dat:.d September
20, 1995, shall be labeled for the exclusive use of S&D Foods, Inc. and
its owners or affiliates and that the labeling of these spaces shall be
completed and inspected within 30 days (December 7, 1995) after this
action becomes final, and that 14 parking spaces shall not be used for
storage or any purpose other than parking vehicles of owners, employees
or customers;
3. that the on-site parking shall include two disabled accessible parking
spaces (one van) and shall be accessible at all times, and all employees
shall be required to use the on-site parking and shall not park their
vehicles on the public streets;
4. that the outdoor storage and recycling bin areas as indicated on the plans
dated August 23, 1995, shall be enclosed by 8'-0" high opaque fences
and kept clean of waste and debris produced by the canning process and
that all materials for recycling shall be kept contained and clean to
prevent the attraction of rodents and other vermin and the enclosures
shall be maintained in an orderly fashion and in good repair by the
property owner and/or tenant; the fenced enclosures shall be installed
within 30 days (December 7, 1995) after this action becomes final;
5. that the conditions set forth in the Associate Engineer's memo dated
August 28, 1995 shall be met including that a discharge permit shall be
applied for and required interceptors installed on the sanitary sewer
within 60 days (January 7, 1996) of the final action on this permit;
6. that all loading and unloading of goods and materials to be used at this
location shall take place on the site including recycling and trash pickups
and no materials, attached or unattached trailers or other vehicles
associated with this manufacturing business shall be stored or left
unattended on any public street or right-of-way; and
7. that the number of employees of S & D Foods, Inc. and its owners or
affiliates on site at any one time shall not exceed 14; any increase in the
number of employees or change in operations which exceed the capacity
and use areas of the site established at the time of this permit shall
require this use permit to be amended by the Planning Commission.
