RESOLUTION DENYING CONDOMINIUM PERMIT, DISAPPROVING
NEGATIVE DECLARATION AND DENYING SUBDIVISION MAP -
962 CHULA VISTA
RESOLVED, by the City Council of the City of Burlingame
that:
WHEREAS, application was made to the Planning Commission
of the City of Burlingame for a four unit residential condominium
permit at 962 Chula Vista Avenue; and
WHEREAS, said application and the negative declaration
and condominium permit therefore were heard by the Planning
Commission of the City of Burlingame on November 12, 1991, said
hearing being properly noticed as required by law; and
WHEREAS, the negative declaration was approved, the
condominium permit was denied and denial of the subdivision map
were recommended by the Planning Commission, a timely appeal was
filed, and a public hearing upon said appeal was scheduled and held
by the City Council on January 6, 1992:
NOW, THEREFORE, IT IS ORDERED AND DETERMINED by the City
Council of the City of Burlingame:
1. On the basis of the Initial Study, the documents submitted
and reviewed, and comments received and addressed by the Planning
Commission and this Council, it is hereby found that this project
may have significant effects on the environment including:
inconsistency with the mass and bulk of existing development,
substantial effect on air and light access of adjacent properties,

exacerbation of existing impacted neighborhood parking by the
location of visitor parking, endangerment of existing large trees,
and provision of inadequate private and common open space.
Negative Declaration ND -447-P is therefore not approved.
2. That the following findings of fact are made regarding
said application:
(a) The application is for a 4 unit condominium at 962 Chula
Vista Avenue, as more fully set forth in said application dated
September 5, 1991;
(b) The condominium as described in the staff report and in
the testimony at the hearing does not meet the condominium
standards of the Burlingame Municipal Code, in that the private
open space.provided for individual units is not designed so as to
be actually usable, the common open space is divided by a parking
space so as to be unsafe and not usable, the location of the guest
parking behind a security gate and the placement of the guest
parking stall discourages its use and affects the use of other
parking spaces thereby impacting neighborhood parking, and the bulk
and size of this project is not compatible with existing
development in the neighborhood and could negatively impact future
development of the area.
3. The granting of the condominium permit would not be in
the interests of the health and welfare of the persons using said
property, of the City of Burlingame, or in conformity with
reasonable and orderly use of the property.

4. The decision of the Planning Commission denying the
condominium permit for 962 Chula Vista Avenue is hereby affirmed.
For the reasons set forth above it is determined that there may be
significant effects on the environment and the negative declaration
is therefore not approved. The subdivision map for said project is
denied. n
