RESOLUTION APPROVING
CATEGORICAL EXEMPTION AND SPECIAL PERMIT
RESOLVED by the CiiY COUNCIL of the City of Burlingame that
WHEREAS, a categorical exemption has been proposed and application has been made for a
special permit for sale of food and beverages at a gas station at 177 California Drive, APN: 029-
23�; property owner: Peter Lee, 1480 Triumph Court, San Jose. CA ; and
WHEREAS, the Planning Commission held a public hearing on said application on Sotember
26 , 1995 , at which time said application was approved;
WHEREAS, this matter was called up by City Council and a hearing thereon held on October
16. 1995 , at which time it reviewed and considered the staff report and all other written materials and -
testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this council, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption
Section: 15301- Existing Facilities, Class 1(a) , Interior or exterior alterations involving such things
as interior partitions, plumbing, and electrical conveniences is hereby approved.
2. Said special permit is approved subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such Special Permit are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

foregoing resolution was introduced at a regular meeting of the City Council held on the 16th day
of October , 1995 , and adopted thereafter by the following vote:

Conditions of approval categorical exemption and special permit

effective OCTOBER 16, 1995
1. that the tenant improvements for the snack shop shall be installed as shown on the plans
date stamped August 24, 1995, Site Plan and Floor Plan with at least two on-site parking
stalls, one designated for employees and one designated for snack shop customers;
2. that no alcoholic beverages shall be sold from the site of the snack area;
3. that the hours of operation shall be from 7:00 AM to Midnight seven days per week and 5 full
time and 2 part time employees:
4. that the property owner shall be responsible for policing the site and adjacent sidewalks for litter
and that adequate trash receptacles shall be placed inside the building and around the site for use
by the customers; and
5. that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes
as amended by the City of Burlingame.
