HomeMy WebLinkAboutReso - CC - 038-1994RESOLUTION NO. 38-94 RESOLUTION APPROVING NEGATIVE DECLARATION, CATEGORICAL EXEMPTION, PARKING VARIANCE AND SPECIAL PERMIT AMENDMENT RESOLVED by the CITY COUNCIL of the City of Burlingame that: WHEREAS, a negative declaration and categorical exemption has been proposed and application has been made for a Parking Variance and Special Permit Amendment for 33 stalls and to increase the number of fixed seats from 54 to 250 at 1157 California Drive: APN 026-191-3001. Property owner: Dillon Management Company. Inc.; and WHEREAS, the Planning Commission held a public hearing on said application on May 23 , 1994 , at which time said application was approved; and WHEREAS, this matter was called up by City Council and a hearing thereon held on June 20. 1994 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this council, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Negative Declaration ND -472 P and categorical exemption Article 19, Section 15301, Class 1(a), Interior or exterior alterations involving such things as interior partitions, plumbing and electrical conveyances is hereby approved. 2. Said parking variance and special permit amendment are approved subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such parking variance and Special Permit amendment are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. MAYOR I, JUDITH A. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 20th day of June 1994 , and adopted thereafter by the following vote: AYES: COUNCILMEMBERS: HARRISON, KNIGHT, O'MAHONY,PAGLIARO, SPINELLI NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE 75 CITY CL2RK 4/ EXHIBIT "A" Conditions of approval negative declaration, categorical exemption parking variance and special permit amendment 1157 California Drive effective June 20, 1994 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped April 7, 1994 Site Plan. and General Floor Plan; 2. that the conditions of the Fire Marshals' April 11, 1994 memo shall be met (a complete fire alarm system must be installed meeting the American Disabilities Act requirements); 3. that church services shall be spaced not less than 60 minutes apart; 4. that the church use shall be limited to services Monday through Friday 7:30 P.M. to 9:30 P.M.; Saturday 10:30 A.M. to 12:30 P.M. and 6:00 P.M. to 8:00 P.M.; and Sunday 10:30 A.M. to 12:30 P.M. and 6:00 P.M. to 8:00 P.M. with a maximum of four employees at any one time; 5. that the church use shall be limited to a maximum of 250 people (and 250 seats) per service and the site shall be used Monday through Sunday from 8:00 A.M. to 10:00 P.M. for related church activities with a maximum of 10 people per meeting except during designated church services; 6. that the on-site parking shall be marked for the exclusive use of the church and other businesses on site and shall never be leased or sold separately from the building; 7. that the other two leased areas on the site shall continue in retail use and not be intensified to other more parking intensive uses; 8. that the church facilities shall not be leased or rented to any other groups but may be used by other religious, self help and community groups as specified by Conditions 4 and 5; 9. that separate application shall be made for signage for the church use; and 10. that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame.
