RESOLUTION NO. 94-96
RESOLUTION APPROVING CATEGORICAL EXEMPTION,
PARKING VARIANCE, MASTER SIGN PROGRAM
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
parkin¢ variance for dimensions for 16 required stalls in order to add a used car sales business and
a master sign program and sign exceotion for area and number of signs on the urimary frontae

WHEREAS, the Planning Commission held a public hearing on said application on October
>$, 1996 , at which time said application was denied;
WHEREAS, this matter was _aRMaM to Cily Council and a hearing thereon held on
December 2. 1996 , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that
the project set forth above will have a significant effect on the environment, and Categorical
Exemption per Article 19. per Section: 15301 - Existing Facilities, Class 1(a), Interior or exterior
alterations involving such things as interior partitions, plumbing, and electrical conveyances and Class
1 -minor exterior alterations (signs) is hereby approved.
2. Said parking variance, master sign program and sign exception is approved, subject to the
conditions set forth in Exhibit "A" attached hereto. Findings for such parking variance, master sign
program and sign exception are as set forth in the minutes and recording of said. meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

foregoing resolution was introduced at a regular meeting of the City Council held on the 2nd day
of December , 1996 , and adopted thereafter by the following vote:

Conditions of approval parking variance, master sign program and sign exception
1041-1049 BROADWAY
effective DECEMBER 2, 1996
1, that the project shall be built as shown on the plans submitted to the Planning
Department and date stamped November 21, 1996, site plan; September 17, 1996
Sheet 1 floor plan, and August 6,1996 (three sheets) Pole Sign Sheet -West Elevation,
Pole Sign Sheet -Plan view and Side Elevation and Pole Sign Sheet - Perspective
sketch;
2. that the conditions of the Chief Building Inspector's September 30, 1996 memo (if
parking lot is restriped, one accessible van space, 9' wide plus 8' unloading area
shall be required as a part of the 16 required parking stalls);
3. that all the existing banners, and A -frame board signs for both Mike Harvey Honda
and Monney Car Audio along Broadway and at the parking lot shall be removed;
4. that all the temporary bunting surrounding the light pole signs (bunting materials but
not the signs) along Broadway shall be removed prior to issuance of a building
permit for installing the new signs;
5; that the project shall meet California Building and Fire Code 1995 edition
requirements as amended by the City of Burlingame;
6. that the entrance off Broadway and exit onto Carolan be clearly marked;
7. that customer parking be signed and not used by employees;
8. that employee parking for 1041-1049 Broadway sales personnel be specifically
identified on the JPB, right-of-way across the street adjacent to the Acura sales and
service center leased by Mike Harvey;
9. that if Mike Harvey should loose the lease on the JPB right-of-way used for
additional parking adjacent to the Acura site, then the parking variance for 1041-
1049 Broadway becomes void;
10. that fourteen parking spaces for employees and customers shall be provided on the
1041 Broadway site one of which shall be designated and signed as a disabled
accessible van space and 13 of which shall be signed on the pavement as customer
and employee parking;

11. that space number 23 shall be removed from the parking plan in order to provided
safe and adequate back up area for required parking spaces 2 through 5;
12. that the stripping and pavement markings required by this action shall be installed
within 60 days of the city's final action on this parking variance; and
13. that this parking variance shall have a term of five years (December 2001) at which
time it will become void.
