RESOLUTION AUTHORIZING REWARD FOR INFORMATION
LEADING TO THE CONVICTION OF GRAFFITI VANDALS
WHEREAS, the City Council of the City of Burlingame desires to
continue its efforts to deter or abate graffiti and upgrade the
aesthetic quality of the City; and
WHEREAS, pursuant to the provisions of California Government
Code Section 53069.5, a local agency may offer and pay a reward for
information leading to the apprehension of any person who willfully
damages or destroys property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Burlingame as follows:
1. The payment of a reward in the maximum amount of Two
Hundred Fifty ($250.00) is hereby authorized for information
leading to the arrest and conviction of any person who
willfully damages or destroys public or private property in
the City of Burlingame by use of graffiti.
2. The Chief of Police is hereby authorized to pay such
reward to each person who gives such information provided
that a claim is filed with the City Clerk within sixty
(60) days after conviction and that such claim is
approved by the Chief of Police and the City Attorney.
3. Only one such Two Hundred Fifty Dollar ($250) reward
shall be payable by the City for each conviction. In the
event more than one person claims such reward for any
conviction, the Two Hundred Fifty Dollars ($250) reward
shall be divided equally among the total number of
persons determined by the City. The City shall have sole
and absolute discretion in making any determination
regarding (a) whether to pay any reward (b) to whom
payment shall be made, and (c) any other matters relating
to the provisions of this Resolution.
4. As specified in Government Code Section 53069.5, any
person who has willfully damaged or destroyed any public
property located within the boundaries of the City shall
be liable and reimburse the City of the amount of any
reward paid pursuant to this resolution, and if such
person is an unemancipated minor, the parent or guardian
shall also be liable for said amount.
